The framework agreement concerns technical advisory services and assistance in relation to Udviklingsselskabet By & Havn I/S’ (hereinafter referred to as "Contracting Authority") fulfillment of its obligations to carry out the construction of Lynetteholm in accordance with the law on the construction of Lynetteholm (law no. 1157 of 8 June 2021), including carried out environmental impact assessments and the implementation report. The Contracting Authority has prepared a comprehensive environmental impact assessment, which includes an assessment of environmental impacts in the construction and operation phases of Lynetteholm. The environmental impact assessment contains proposals for mitigation measures, which should minimise the impact on nature and the environment, and proposals for a monitoring programme, which should show whether there is any unintended impact on nature and the environment. The implementation report describes how consideration for the environment and nature, as well as the implementation of mitigation measures, will be handled with regard to the relevant environmental and nature interests affected by the construction project. The Contracting Authority shall, in accordance with the implementation notice, monitor the impact of construction work on sediment conditions and the impact on water quality in the construction and operation phases. The Contracting Authority shall also carry out monitoring of the seabed vegetation and seabed fauna around Lynetteholm. These obligations have resulted in a monitoring programme, which monitors several parameters such as animals, plants and water quality, so that it is ensured on an ongoing basis that the applicable environmental requirements are complied with. The environmental monitoring programme has been carried out since the start of the project and will continue to be carried out in the coming years. Furthermore, the Contracting Authority is, as a condition for the construction and operation phase, obliged to document to the supervisory authority that necessary measures for the discharge of nitrogen (N) and phosphorus (P) have been established in a binding plan, which ensures that the discharge will not result in a deterioration of the ecological status of the coastal waters or hinder the achievement of the environmental objective of good ecological status in 2027 and beyond. The advisor shall, inter alia, assist with this. The framework agreement relates to the delivery of technical advisory services and assistance in connection with environmental monitoring at Lynetteholm, including, inter alia, assistance with the implementation of the environmental monitoring programme and the Binding Plan approved by Københavns Kommune, as well as general services within recipient and coastal technical investigations in relation to Lynetteholm and the adjacent area. The framework agreement includes, inter alia, technical advisory services and assistance to the Contracting Authority regarding: • Marine monitoring • Regional and local water exchange • Water quality and bathing water quality • Sediment discharge and environmentally beneficial substances • Review services • Media handling, including public written and oral statements in support of the Advisor's professional assessments. The framework agreement enters into force on 1 January 2027. The Advisor shall, prior to the framework agreement coming into force, carry out any purchases and other preparatory actions that may be necessary for the environmental monitoring to be initiated as of 1 January 2027. The Advisor shall also (for payment in accordance with the framework agreement) complete the tasks that have been initiated in the framework agreement period, regardless of whether this completion is to be carried out after the framework agreement's expiry date. The estimated value of the framework agreement is DKK 30,000,000 and its maximum value is DKK 35,000,000. The maximum value of the framework agreement may be increased by up to 20%, if the consumption on the framework agreement after two years is more than 50% of the maximum value, see further regulation in section 6 of the framework agreement. The framework agreement is not exclusive.
