Description

Subject of the contract: Granting a long-term bank loan in the amount of 4,800,000 PLN, intended to finance the planned budget deficit of the Gmina Tykocin for 2026. Procedure identifier (ID): ocds-148610-b84b141e-1b2e-4f49-b017-7400be91e5cc

2. The contracting authority does not allow contractors to apply a preparatory fee - such offers will be rejected and 60% of the contract will be reserved.

3. The contractor must familiarise themselves with all the provisions of the SWZ. The contractor should obtain all the information that may be necessary to prepare the offer and conclude the contract for the implementation of the Contract. The subject of the contract is defined in the subject SWZ and its annexes, which the contracting authority has attached for the correct calculation of the offer price.

4. Link to regulations, resolutions, financial reports, multi-year financial forecasts (…). On the BIP page, there are documents enabling the examination of the creditworthiness of the Gmina: Resolution No. 57/2026 of the Mayor of Tykocin of 10 July 2026. The contracting authority informs that, in accordance with art. 139(1) of the Pzp Act, it will first examine and evaluate the offers, and then qualify the contractor whose offer is the highest, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure.

6. The contracting authority does not divide the contract into parts.

7. Contractors who meet the conditions relating to: 1. authorisations to carry out a specific economic or professional activity, if this results from separate provisions: authorisations to carry out a specific economic or professional activity, if this results from separate provisions; - The contractor has a permit from the Financial Supervision Commission to carry out banking activity in Poland, as well as to provide services covered by the subject of the contract, in accordance with the provisions of the Act of 29 August 1997 on Banking Law (i.e. Journal of Laws of 2026, item 38 with later amendments) art. 36, and in the case specified in art. 178(1) of the Banking Law Act, another document confirming the commencement of activity before the entry into force of the Act referred to in art. 193 of the Banking Law Act or equivalent documents (confirming the right to carry out banking activity in Poland in the scope of banking services and granting loans in accordance with the provisions of the aforementioned Act). In accordance with art. 117(2) of the Pzp Act - with regard to contractors jointly applying for a public contract, the condition will be met if at least one of the contractors jointly applying for the award of the contract referred to in art. 112(2)(2) of the Pzp Act, has a permit to carry out banking activity in Poland and also to provide services covered by the subject of the contract, in accordance with the provisions of the Act of 29 August 1997 on Banking Law (i.e. Journal of Laws of 2024, item 1646 with later amendments), and in the case specified in art. 178(1) of the Banking Law Act, another document confirming the commencement of activity before the entry into force of the Act referred to in art. 193 of the Banking Law Act and will provide services, for the provision of which these authorisations are required. 2.2 technical or professional capacity: The contracting authority does not set a condition in this respect. 2.3 economic or financial situation: The contracting authority does not set a condition in this respect. 2.4 capacity to operate in the economic market: The contracting authority does not set a condition in this respect.

8. Contractors will be excluded from the procedure for the award of the contract if any of the following circumstances apply to them: 1) in art. 108(1) p.z.p. – mandatory; 2) in art. 109(1)(1) p.z.p. – discretionary; j. who has breached obligations relating to the payment of taxes, fees or social or health insurance contributions, except in the case referred to in art. 108(1)(3), unless the contractor has made the payment of the due taxes, fees or social or health insurance contributions together with interest or penalties before the deadline for submitting applications for admission to the procedure or before the deadline for submitting offers, or has entered into a binding agreement on the repayment of these liabilities 3) in art. 109(1)(4) p.z.p. – discretionary; i.e.: in respect of whom liquidation has been opened, bankruptcy has been declared, whose assets are managed by a liquidator or a court, has entered into an agreement with creditors, whose business activity is suspended or is in another similar situation resulting from a similar procedure provided for in the provisions of the place where this procedure was initiated; 4) art. 7(1) of the Act of 13 April 2022 on special solutions to counter the support of aggression against Ukraine and serving to protect national security (i.e. Journal of Laws of 2025, item 514); 5) art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, as amended by Council Regulations (EU) 2022/1269, 2023/1214, 2025/395, 2025/2033 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine.

9. In selecting the most advantageous offer, the contracting authority will be guided by the following criteria, which will have the significance specified below: Price – 100% (max. 100 points). The contracting authority will award points in this criterion on the basis of the information contained in the offer form: The "Price" criterion will be calculated according to the formula: Cn C = --------- x 100 x 100% Co where: C – points awarded in the "Price" criterion, Cn – the lowest price (of the non-rejected offers) – gross value A from the offer form, Co – offer price.
