The contracting authority wishes to acquire orthopedic products as described in the annex to the terms of reference, divided into 53 lots. Considering the object of the acquisition and the technical characteristics, it can be considered that the acquisition has a high degree of complexity. The section requests the initiation of the public procurement procedure with the respect of the lot division from the need reference NR.45/10.08.2026, and the reason for requesting the consolidation of the products into a single lot for the lots that include sublots is as follows: “since all products in a lot must be compatible (i.e. in the same ecosystem) with each other. The technical specifications of each lot in part are found in the Terms of Reference Annex 1. A framework agreement will be concluded for a period of 36 months. It is estimated that a minimum of 1 and a maximum of 12 subsequent contracts will be concluded in a calendar year, with the highest frequency of the largest subsequent contract being concluded in 12 months. The estimated minimum and maximum quantities of the subsequent contracts are found in Annex to the procurement strategy and Annex 2 to the terms of reference, these being estimates. The awarding authority is not obliged to purchase either the minimum or the maximum quantity during the framework agreement, as specified in the annex. Furthermore, the quantity that is estimated to be purchased during the framework agreement and specified in the award documentation will be purchased depending on the existence of funds allocated for this purpose and the needs of the contracting authority. In a duly justified case, the maximum quantity estimated in the framework agreement may be supplemented in accordance with the provisions of art. 221 of Law 98/2016 on public procurement. The deadline within which AC will respond clearly and completely to all requests for clarification/information will be the 11th day before the deadline for submission of tenders in accordance with art.160 in conjunction with art.161 of Law 98/2016 as amended and supplemented. Number of days until which clarifications can be requested before the deadline for submission of tenders/applications: 20 days. The winning bidder of the 1st place will provide the Hospital with the specific instrumentation, necessary for the operation and implantation of the product and will ensure the service, replacement of the instrument and defective components, for the entire duration of the program, within a maximum of 48 consecutive hours from the detection of the defect. The costs related to the instrumentation, service, replacement of the instrument and defective components will be found in the value of the offered product. In the event of termination of the contract with the economic operator ranked in 1st place, it will proceed to the 2nd place which will provide the Hospital with the specific instrument, necessary for the operation and implantation of the product and will ensure the service, replacement of the instrument and defective components, for the entire duration of the program, within a maximum of 48 consecutive hours from the detection of the defect. The costs related to the instrumentation, service, replacement of the instrument and defective components will be found in the value of the offered product. In the event of termination of the contract with the economic operator ranked in 2nd place, it will proceed to the 3rd place which will provide the Hospital with the specific instrument, necessary for the operation and implantation of the product and will ensure the service, replacement of the instrument and defective components, for the entire duration of the program, within a maximum of 48 consecutive hours from the detection of the defect. The costs related to the instrumentation, service, replacement of the instrument and defective components will be found in the value of the offered product.
