Poland – Electricity, heating, solar and nuclear energy – Dostawa energii elektrycznej dla Powiatu Jarosławskiego

The subject of the contract is the supply of electrical energy to the Contracting Authority's points of electricity consumption, in accordance with the provisions of the Act of 10 April 1997 on Energy Law (consolidated text Journal of Laws 2026, item 43, as amended), hereinafter referred to as the "Energy Law Act," and the executive acts issued on its basis, with specified quality standards. The quality standards for electrical energy are described in the Energy Law Act, the Regulation of the Minister of Climate and Environment of 22 March 2023 on detailed conditions for the functioning of the power system (consolidated text Journal of Laws 2025, item 919, as amended), and the Regulation of the Minister of Energy of 3 September 2026 on the method of shaping and calculating tariffs and the method of settlements in electricity trade (Journal of Laws 2026, item 1182). 2. A detailed description of the subject of the contract, as well as the requirements and rules for the implementation of the contract, are specified in the Draft Contract Terms constituting Annex No. 3 to the SWZ, together with the list of points of electricity consumption constituting Annex No. 2 to the SWZ. 3. In the event that the Contracting Authority installs renewable energy sources (RES) installations during the term of the Agreement, the Contractor shall be additionally obliged to purchase/settle surpluses of electrical energy generated in RES installations that have been fed into the relevant local OSD power grid. The detailed rules for settlements will be specified in the document presented by the Contractor (supplement, regulations, electricity sales agreement for energy generated from renewable sources). The Contractor's Template will not contain any provisions imposing additional financial burdens on the Contracting Authority not provided for in this SWZ.
