Poland – Construction work – WSZ-EP-14/2026 - Budowa nowego bloku łóżkowego - przeniesienie Oddziału Ginekologiczno-Położniczego, Oddziału Noworodkowego oraz Oddziału Dziecięcego na ul. Szpitalną 45
Description
The subject of the contract is “Construction of a new ward block - relocation of the Gynaecology and Obstetrics Department, Neonatology Department and Paediatric Department to 45 Szpitalna Street”. 2. A detailed description of the subject of the contract is contained in the project documentation constituting Annexes numbered 2.1 to 2.3 to the SWZ and an Annex entitled: “Changes to the project documentation” containing changes to the project documentation together with the Reception Room Concept. 3. The conditions for the implementation of the subject of the contract are also set out in the Draft Contract Terms, constituting Annex No. 7 to the SWZ. 4. The contract is co-financed from the budget of the Wielkopolskie Voivodeship within the framework of the Grant Agreement No. DZ-IV-A/21/2022. 5. The Contracting Authority has not divided the contract into parts and does not allow the possibility of submitting partial bids. The subject contract, i.e. the construction of a new ward block - relocation of the Gynaecology and Obstetrics Department, Neonatology Department and Paediatric Department, has not been divided into parts due to the specificity of the services and construction works covered by the subject of the contract. In particular, this applies to the individual components of the subject of the contract, which are integrated with each other in a way that excludes the possibility of one element functioning without the other so that the implementation of the whole task is maintained and in order to eliminate the potential situation in which the Contracting Authority receives only part of the subject of the contract and is then unable to ensure the proper functioning of the whole. The subject of the contract covers one investment intention, which will be implemented on the basis of the issued building permit decision. Furthermore, dividing the contract into parts would also be disadvantageous for the Contracting Authority due to the risk of extending the implementation time, increasing investment costs, the possibility of technical problems arising during the implementation phase (incompatibility of solutions). Another argument against dividing the contract is the difficulties in coordinating work and enforcing rights arising from guarantees, i.e. “dissipating” responsibility to contractors of individual parts, lack of obtaining one guarantee for the whole investment. Also, the possibility of dividing the contract, due to the above reasons (mainly concerning technical and coordination of work), is not envisaged by the developed, multi-disciplinary project documentation, on the basis of which the building permit decision was issued. 6. The Contracting Authority does not allow the submission of variant bids. 7. The Contracting Authority requires a bid to be submitted after the contractor has carried out a site visit. Before preparing and submitting a bid, a site inspection must be carried out in order to obtain the necessary information to carry out a correct valuation of the future place of execution of the subject of the contract. The site visit will enable Contractors to obtain information useful for preparing a bid, including familiarisation with the technical condition of the existing infrastructure. A list of attendees and a protocol will be drawn up in writing from the site visit, which, signed by the Contracting Authority and the Contractor, will constitute confirmation of the site visit having been carried out by the Contractor. The site visit will take place on 28.07.2026, - Meeting at 10:00 at the entrance to the main hospital building (Building D) at 45 Szpitalna Street in Konin. In accordance with art. 226(1)(18) of the PZP Act, the Contracting Authority rejects a bid if it has been submitted without a site visit with the Contracting Authority. 8. Requirements regarding the employment of persons under an employment contract. The Contracting Authority requires the Contractor or subcontractor to employ persons under an employment contract to perform the following tasks within the scope of implementing the subject of the Contract: physical work in the execution of construction works and related works, with the exception of works carried out by persons performing independent technical functions in construction within the meaning of the provisions of the Building Law Act - if the performance of these tasks involves carrying out work in a manner specified in art. 22(1) of the Labour Code of 26 June 1974. The principles of employing persons under an employment contract have been specified in the Draft Contract Terms, constituting Annex No. 7 to the SWZ. 9. In this procedure, communication between the Contracting Authority and Contractors takes place using electronic communication means, via the Procurement Platform, operating at https://platformazakupowa.pl/wsz_konin. Detailed requirements in this regard in accordance with the provisions of Chapter XI of the SWZ. 10. The SWZ together with the annexes the Contracting Authority will make available on the website of the conducted procedure: https://platformazakupowa.pl/transakcja/1293911 11. The Contracting Authority may invalidate the contract award procedure before the deadline for submitting bids if circumstances arise that make it unreasonable to continue the procedure - in accordance with art. 256 of the PZP Act. The Contracting Authority informs that, pursuant to art. 95d of the Act of 27.08.2004 on health services financed from public funds, it has applied to the Voivode of Wielkopolskie for an opinion on the justification of the investment, for the task which is the subject of this contract award procedure. Failure to obtain a positive opinion on the justification of the investment may be considered to be the occurrence of a circumstance that makes it unreasonable to continue the procedure, and as a result may constitute the basis for the invalidation of the procedure. 12. The Contracting Authority does not allow the possibility of exercising the right of option. 13. The subject of the contract should be carried out in accordance with Polish Standards, with the currently applicable legal provisions in this scope, including the provisions of the Building Law Act, BHP and Ppoż regulations, norms, knowledge and building art - other requirements in accordance with the provisions of Chapter IV of the SWZ. 14. Requirements regarding subcontracting, resource sharing and GDPR are set out in the SWZ.
