The subject of the public procurement contract is the performance of repairs to RM type circuit breakers, including their connection to follow-on technologies, control cabinets and provisional securing of their operation in case of emergency and during their repair in stations, technical centers and metro lines, under the conditions specified in the framework agreement. The framework agreement will be concluded with one participant. Individual partial performances carried out on the basis of the framework agreement will take place on the basis of partial orders. The subject of the performance on the basis of the framework agreement is the actual replacement of individual components or their assemblies in the existing electrical circuit breakers NN and control cabinets in the metro network. In view of the requirements placed on these circuit breakers and control cabinets, in particular § 47 and n. of Act No. 266/1994 Coll., on Railways, as amended (hereinafter referred to as the "Railways Act"), the contracting authority insists that the participants in their submitted proposals for the framework agreement offer and evaluate exclusively the elements and components specified for the individual types of circuit breakers and control cabinets in the relevant model project documentation. This requirement also applies to the specific type designation of the respective element or component including its manufacturer. Since a possible change in the equipment of the circuit breaker or control cabinet compared to its project documentation may affect the circuit breaker's ability to operate in accordance with § 48 (2) of the Railways Act, the requirement of the contracting authority set out in this paragraph is fully justified by the nature of the subject of the public procurement. The performance on the basis of the framework agreement will take place in accordance with the technical specification for the individual electrical circuit breakers and control cabinets set out in Annex No. 1 of the framework agreement. The said electrical circuit breakers and control cabinets are the designated technical equipment in accordance with § 47 of the Railways Act. Before the designated technical equipment is put into operation, its fitness for operation must be approved. This fitness for operation is approved by the railway administrative authority by issuing a certificate of fitness. All repairs to the circuit breakers must therefore unconditionally respect the "Procurement Conditions for the Manufacture and Supply of Circuit Breakers up to 0.6 kV AC and DC for the Prague Metro" according to DPP Technical Protocol No. 18/2019. The repairs must be carried out in accordance with the project documentation for the individual types of circuit breakers mentioned above.
