Poland – Works for complete or part construction and civil engineering work – Wykonanie kompletnej dokumentacji projektowej oraz wykonanie na jej podstawie robót budowlanych dla zadania inwestycyjnego pn.: „Przebudowa i budowa Stadionu Lekkoatletycznego - kompleks lekkoatletyczno-piłkarski”.

Execution of the complete project documentation and the construction works based on it for the investment task entitled: "Reconstruction and Construction of the Athletic Stadium - athletics and football complex". The following contractors are excluded from the tendering procedure: those in respect of whom any of the circumstances indicated in: 1) Article 108(1) and Article 109(1)(7), (8) and (10) of the Public Procurement Law (Pzp); 2) Article 7(1) of the Act of 13 April 2022 on special solutions to counter support for the aggression against Ukraine and to protect national security. The exclusion of the contractor applies for the duration of the circumstances specified in Article 7(1) and does not apply to the exclusion from the procedure under Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229, 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 111, 8.4.2022, p. 1), hereinafter: Regulation 2022/576. 3. Contractors who meet the following conditions may apply for the contract:

Economic or financial situation: a) The contractor must demonstrate that it has financial resources or credit capacity of at least 25,000,000.00 PLN (twenty-five million zlotys). In the case of a joint bid, the above condition may be met jointly, provided that at least one of the contractors jointly applying for the contract has financial resources or credit capacity of at least 15,000,000.00 PLN (fifteen million zlotys).

Technical or professional capacity: a) The contractor meets the condition if it demonstrates that it has/had at least 1 person who will participate in the execution of the contract as a lead architect, possessing valid architectural design authorisation without restrictions, who has prepared at least 2 design documents for an athletics stadium agreed and approved by PZLA in the last 4 years. b) The contractor meets the condition if it demonstrates that it has/had at least 1 person who will participate in the execution of the contract as a construction manager, possessing valid construction authorisation without restrictions to manage construction works in the construction and civil engineering speciality, who has at least 5 years of experience in performing independent technical functions in construction and has acted as a construction manager for at least 2 athletics, football or athletics and football stadiums each with a value of at least 10,000,000.00 PLN. c) The contractor meets the condition if it demonstrates that it has/had at least 1 person who will participate in the execution of the contract as a works manager, possessing valid construction authorisation without restrictions to manage construction works in the installation speciality in the field of networks, heating, ventilation, gas, water supply and sewerage systems, who has at least 6 years of experience in performing independent technical functions in construction and has acted as a construction manager or works manager for at least 2 public utility buildings each with a usable area of at least 1,000 m2. d) The contractor meets the condition if it demonstrates that it has/had at least 1 person who will participate in the execution of the contract as a works manager, possessing valid construction authorisation without restrictions to manage construction works in the installation speciality in the field of electrical and power engineering systems, who has at least 6 years of experience in performing independent technical functions in construction and has acted as a construction manager or works manager for at least 2 athletics, football or athletics and football stadiums. e) The contractor meets the condition if it demonstrates that in the 10 years prior to the deadline for submission of tenders, or if the period of business operation is shorter – in that period, it has properly executed at least 1 construction work involving the construction/ reconstruction or modernisation of a sports stadium, with a value of at least 13,000,000.00 PLN, on which an athletics track (min. 4 lanes 800 m) was constructed and a PZLA certificate of at least category IV was obtained. f) The contractor meets the condition if it demonstrates that in the 10 years prior to the deadline for submission of tenders, or if the period of business operation is shorter – in that period, it has properly executed at least 1 construction work involving the construction/ reconstruction or modernisation of a sports stadium meeting the necessary requirements to play at least in the IV league according to the requirements set by the Polish Football Association (PZPN), with a value of at least 15,000,000.00 PLN gross. g) The contractor meets the condition if it demonstrates that in the 5 years prior to the deadline for submission of tenders, or if the period of business operation is shorter – in that period, it has properly executed at least 2 construction works involving the construction/ reconstruction or modernisation of cubature objects with a value of at least 20,000,000.00 PLN gross each. It is permitted to meet each of the conditions described in points e) – g) separately (the experience of another entity may relate to all or selected conditions). It is not permitted to refer to part of the experience described in each of points e) – g) (summing up experience in the scope of one point).
