Bulgaria – Road construction works – „Рехабилитация на част от път PDV 3235 III-565, Шишманци-Оризово /-Белозем-Болярино-Граница общ. (Раковски-Брезово)-Чоба- /III-666/, община Раковски“, Подобект: от km 0+000 до km 3+965 (северно от с. Болярино)“

The subject of this public procurement is: „Rehabilitation of part of road PDV 3235 III-565, Shishmantsi-Orizovo /-Belozem-Bolyarino-Granitsa (Rakovski-Brezovo)-Choba- /III-666/, Rakovski Municipality“, Sub-object: from km 0+000 to km 3+965 (north of Bolyarino village)“. The construction object is Category III according to the Construction Act. There is a completed project and a building permit in force for the object. Note: The full description of the subject of the procurement is contained in the Technical Specification – Appendix No. 1 to the procurement documentation, the project and the Contract. Source of financing: At the opening of this public procurement procedure, financing has not been secured, therefore a clause for deferred performance is provided for in the draft contract, pursuant to Article 114 of the Public Procurement Act. In this case, each of the parties may request termination of the contract without notice after the expiry of a three-month period from its conclusion. It should be noted that, pursuant to Article 114, paragraph 2 of the Public Procurement Act, performance under the contract begins after confirmation from the contracting authority that financing has been secured and the contractor has provided the required performance guarantee. When financing has not been secured 10 months after the conclusion of the contract, the contract is deemed to have been terminated. (Article 114, paragraph 4 of the Public Procurement Act). Deadlines: - The term of the construction contract starts from the date of its signature and ends on the date of performance of all obligations undertaken by the Parties under the Contract. - The deadline for the execution of the construction and installation works is offered by the contractor in calendar days. - start: the date of the proper signature of Protocol No. 2/2a for the opening of the construction site and the determination of the construction line and level of the structure according to Appendix No. 2/2a to Article 7, paragraph 3, item 2 of Ordinance No. 3/2003 for the preparation of acts and protocols during the construction; - end: the date of signing, by all participants in the investment process, of the Certifying Act for determining the readiness for acceptance of the structure – Appendix No. 15 to Article 7, paragraph 3, item 15 of Ordinance No. 3/2003 for the preparation of acts and protocols during the construction. The contracting authority determines the limits regarding the permissible deadline for the execution of the construction and installation works: 180 (one hundred and eighty) calendar days minimum execution period, resp. 240 (two hundred and forty) calendar days maximum execution period. When preparing their offers, participants must comply with the specified minimum and maximum deadlines for the execution of construction and installation works. When submitting the offer and formulating the deadline for execution, the participant must necessarily propose a deadline for execution in calendar days and in whole numbers. A participant who proposes a deadline for execution not in calendar days and/or not in whole numbers will be excluded! The contract enters into force from its signature. The parties commence the construction works after receiving a notice from the contracting authority to the contractor for secured financing.
