The Épinal Agglomeration Community established itself as a purchasing centre by decision no. 134/2013 of 8 July 2013 to offer buyers subject to the Public Procurement Code, and having their registered office within the territory of the agglomeration, a system allowing them to meet the objectives of simplifying the purchasing act, legal security and optimising expenditure. Thus, the Purchasing Centre acts as an intermediary in accordance with Article L.2113-2, 2° of the public procurement code for any buyer established within the territory of the agglomeration and, to this end, assumes responsibility for the conduct of the procedures and their legality. The list of members participating in the present consultation is attached in the annex to the commitment act of the present framework agreement. For the performance of the subject matter of this contract: • the purchasing centre, as coordinator, is the buyer responsible for the preparation, award, signature and notification of the framework agreement, the related subsequent contracts and any associated amendments; • each member is responsible, for its part, for executing the contract for what concerns it. The present framework agreement has as its subject the supply of electricity for the own needs of each member, including the following services: • the complete supply of electricity to the delivery points of the members, • the coverage of the obligations associated with the capacity guarantees, • the mission of balance responsible associated with the electricity consumption of the delivery points of the members; • access to public transport and distribution networks and their use (within the framework of a single contract); • the ancillary services to the missions of the Distribution Network Managers (GRD) grouped together in the catalogue of services of these GRD; • all services defined in the Particular Conditions of Contract and in the Specific Conditions of Contract of the relevant subsequent contracts. The contractual set consists of: • a multi-award framework supply agreement in accordance with the provisions of 1° of Article L2125-1 of the Public Procurement Code, without minimum and with maximum (Article R2162-4 of the Public Procurement Code) determined in the conditions set out in Article 1.2.2 of the Particular Conditions of Contract; • subsequent single-award supply contracts without minimum taken in application of the framework agreement. The framework agreement is concluded with the holders until 31 December 2030 inclusive. The period for the performance of the services for the main subsequent contracts is as follows: Subsequent Contract No. 1: from 1 January 2027 inclusive to 31 December 2028 inclusive. Subsequent Contract No. 2: from 1 January 2029 inclusive to 31 December 2030 inclusive. The consultation relating to the subsequent contracts will provide for mandatory Optional Additional Services on the part of the consumption to be associated with certificates of origin guarantees: - PSE1: origin guarantees covering 35% of the estimated annual consumption of the sites concerned - PSE2: origin guarantees covering 100% of the estimated annual consumption of the sites concerned
