The investment task is carried out on the basis of a specific grant awarded by the Silesian Voivodeship, titled: "Purchase of medical equipment for the endoscopy laboratory for the needs of SP ZOZ Szpital Psychiatryczny in Toszek". The subject of the order is the purchase of medical equipment for the endoscopy laboratory for the needs of SP ZOZ Szpital Psychiatryczny in Toszek. The order has been divided into 3 parts. The Detailed Description of the Subject of the Order are Annexes no. 1.2, 2 and 3.1-3.3 to SWZ. 1. Information of the Data Controller, pursuant to Article 13(1) and (2) of the General Data Protection Regulation no 2016/679 of 27 April 2016 (hereinafter: GDPR). It informs that: 1) The data controller is the Independent Public Healthcare Institution Szpital Psychiatryczny w Toszku, operating at 44-180 Toszek, ul. Gliwicka 5, whose registry file is kept by the District Court in Gliwice, X Economic Department of the National Court Register under no. 0000044032, REGON: 000293114, NIP: 9690946632 (hereinafter: Szpital Psychiatryczny w Toszku), email: [email protected], www.szpitaltoszek.pl; 2) A Data Protection Inspector has been appointed, Mr. Paweł Wojciechowski, who can be contacted via email: [email protected] for any matter related to the processing of your personal data; 3) Your personal data will be processed on the basis of Article 6(1)(c) of the GDPR for the purpose related to the subject matter of the proceedings for the award of a public contract, conducted in the procedure of an unlimited tender; 4) the recipients of your personal data will be persons or entities to whom the documentation of the proceedings will be made available on the basis of Article 74 of the Public Procurement Law (Pzp); 5) Your personal data will be stored, in accordance with Article 78(1) of the Pzp, for a period of 4 years from the date of completion of the proceedings for the award of the contract, and if the duration of the contract exceeds 4 years, the storage period covers the entire duration of the contract; 6) the obligation to provide your personal data directly concerning you is a statutory requirement specified in the provisions of the Pzp, related to participation in the proceedings for the award of a public contract. 7) with regard to your personal data, decisions will not be made in an automated manner, in accordance with Article 22 of the GDPR. 8) you have: a) the right, pursuant to Article 15 of the GDPR, to access your personal data (in case the exercise of this right would require disproportionately large effort on the part of the controller, you may be required to provide additional information to specify the request, in particular by indicating the name or date of the public procurement or tender procedure or by specifying the name or date of the completed public procurement procedure); b) the right, pursuant to Article 16 of the GDPR, to rectification of your personal data (the exercise of the right to rectification may not result in a change in the outcome of the public procurement procedure or a change in the provisions of the contract in a manner inconsistent with the Pzp and may not violate the integrity of the protocol and its annexes); c) the right, pursuant to Article 18 of the GDPR, to request the controller to restrict the processing of personal data with the reservation of the duration of the public procurement procedure or tender and the cases referred to in Article 18(2) of the GDPR (the right to restrict processing does not apply to storage, for the purpose of ensuring the use of legal protection measures or for the protection of the rights of another natural or legal person, or on the grounds of important public interest of the European Union or a Member State); d) the right to lodge a complaint with the President of the Personal Data Protection Office, if you consider that the processing of your personal data infringes the provisions of the GDPR; 9) you do not have: a) the right, pursuant to Article 17(3)(b), (d) or (e) of the GDPR, to erasure of personal data; b) the right to data portability, referred to in Article 20 of the GDPR; c) the right, pursuant to Article 21 of the GDPR, to object to the processing of personal data, as the legal basis for the processing of your personal data is Article 6(1)(c) of the GDPR; 10) you have the right to lodge a complaint with the supervisory authority regarding the processing of your personal data by the controller that is not in accordance with the GDPR. The competent authority for the subject matter of the complaint is the Personal Data Protection Office, ul. Stanisława Moniuszki 1A, 00-014 Warsaw. BINDING OFFER TERM: The contractor will be bound by the offer from the expiry of the offer submission deadline, with the first day of the offer binding term being the day on which the offer submission deadline expires – i.e. until 07.02.2027. Contract completion date: by 07.12.2026. The ordering party specifies the final deadline (by indicating a specific date), which constitutes a deviation from the general rule specified in Article 436(1) of the Pzp. The deadline is justified by the necessity to settle the investment with the Marshal's Office of the Silesian Voivodeship (granting the grant). The ordering party, in accordance with the provisions of Article 257 of the Pzp, reserves the right to invalidate the proceedings if the public funds from the specific grant, which it intended to allocate to finance the entire order or its part, are not granted to it.
