Description
The subject of the contract is the conclusion of Framework Agreements for the selection of Contractors who will supply laptop computers, divided into parts: Part 1 - Delivery of laptop computers in configurations A, B and E with a 36-month warranty. Part 2 - Delivery of laptop computers in configurations C and D with a 36-month warranty. 2. The subject of the contract is detailed in Section II SWZ – Description of the Subject of the Contract (Part 1 and Part 2), hereinafter also referred to as the “OPZ”. 3. Pursuant to Article 134(2)(7) of the Pzp Act, the Contracting Authority indicates that it will conclude a Framework Agreement with a maximum of three Contractors in Part 1 and 2 (unless fewer Contractors submit non-rejectable offers), who obtain the highest number of points in the tender evaluation, based on the criteria specified in this SWZ and whose offer price does not exceed the amount allocated for the financing of the given Framework Agreement, with the reservation that the Contracting Authority may increase this amount. In the event that the balance of points obtained is the same for several Contractors, the Contracting Authority will conclude a Framework Agreement with all Contractors. The Contracting Authority does not envisage the selection of the most advantageous offer using Article 227 of the Pzp Act. 4. The Contracting Authority, pursuant to Article 139 of the Pzp Act, envisages a reverse order of tender evaluation, i.e. first it will conduct an examination and evaluation of tenders, and then it will qualify the subject of the Contractor whose tender was rated highest, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. 5. The Contracting Authority is the administrator of personal data within the meaning of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27.4.2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, hereinafter “RODO”. 6. The Contractor submits a tender via the eZamówienia Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/. 7. The Contracting Authority reserves the right, in accordance with Article 257 of the Pzp Act, to invalidate the procurement procedure if the public funds that the Contracting Authority intended to allocate for the financing of the contract are not granted to it. 8. The tender is submitted, under pain of invalidity, in electronic form, according to the requirements strictly specified in the SWZ. 9. The Contracting Authority will not award the contract if the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning certain restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU. L. 2014 No 229, p. 1 et seq. as amended) occur and will exclude the Contractor in the event of the occurrence of at least one of the grounds for exclusion specified in Article 7(1) of the Act of 13 April 2022 on certain solutions in the field of counteracting the support for the aggression on Ukraine and serving the protection of national security (i.e. Dz.U. 2025 item 514) – in order to confirm the absence of grounds for exclusion, a declaration constituting Annex No 7 to the Tender Form must be submitted together with the tender. 10. The Framework Agreements will be valid for 12 months from the date of their conclusion or until the maximum gross value is exhausted, whichever event occurs first. 11. The Contracting Authority will award execution contracts for individual deliveries as needed, based on the Execution Contract, in accordance with the procedures specified in the Framework Agreement. 12. Delivery of the Equipment will take place within a maximum of 20 working days from the date of conclusion of the Execution Contract. 13. The Contractor provides a warranty on the terms indicated in the OPZ for a period of 36 months, with the exception of batteries, for which the Contractor provides a warranty for a period of 12 months. 14. The Contracting Authority requires the submission of subject-specific evidential means with the tender, to confirm the conformity of the offered supplies with the requirements specified in Section II SWZ – Description of the Subject of the Contract and the tender evaluation criteria specified in the description of the tender evaluation criteria specified in Section I SWZ. Detailed information on the subject-specific evidential means to be submitted is specified in point 6 of Section I SWZ.
