Description

Framework agreement for the conclusion of business contracts for the reconstruction works of public sewers predominantly connected to the unified sewerage network in the territory of the Capital, following a procedure reopened for competition, as defined in the framework agreement or for the specific works, in the individual contracts defined as a result. The reconstruction works must be carried out in all cases with open excavation or excavation-free (lining with plastic pipe or jacking with plastic, concrete or reinforced concrete pipe) construction technology, while maintaining public services, on a continuously operating sewer network, or on the connecting pipes, inlets, roof drains, manholes and other structures belonging to it, with the necessary dismantling and subsequent restoration of the road surface. The short name of the procurement procedure: Execution of sewer reconstruction works. The full name of the procurement procedure: Framework agreement for the conclusion of business contracts for the execution of the reconstruction works of the public sewers of Fővárosi Csatornázási Művek Zrt. in the territory of the Capital. According to Kbt. 104.§ (7) point, the Contracting Authority is not obliged to carry out the procurement based on the framework agreement, especially in the case of a framework agreement concluded for several years or if the number of tenderers who concluded the framework agreement does not allow for real competition. In this case, the Contracting Authority must refer to this circumstance in the invitation to tender initiating the new procedure, and – if the procedure is initiated with an invitation to tender – must notify the tenderers who concluded the framework agreement immediately about the publication of the new invitation to tender. A contract based on the framework agreement can only be concluded during the validity period of the framework agreement, and the quantity procured based on the framework agreement must not exceed the total quantity/frame amount specified in the framework agreement. The length of a continuous section within a single contract is designed to be: The Inviting Authority, taking into account the specific characteristics of the water collection areas of the Capital's unified sewerage network and the exposure of the traffic capacities of public areas within the water collection areas, determined the volume to be implemented simultaneously for each water collection area in approximately 3 sewer sections (the average length of a section is 200 m including the lengths of junction and cross branches) due to the loads on the unified sewerage network and the involvement of the predominantly high-traffic urban public areas of the unified sewerage network. In the Capital, the public areas of the older unified sewerage network affected by the reconstruction are predominantly characterized by narrow cross-section, one-way side streets, as well as high-traffic main roads. Interventions in underground utilities on these areas are restricted by the large-scale urban operation on the surface of the public areas (individual access, public access, surface works, pre-announced area occupations, building renovations). On major inner-city roads designated for high traffic, the capacity of the public road cannot satisfy the demand of motor vehicle traffic even without restrictions, and alternative bypasses are often not available in inner-city areas. Furthermore, the large pipe size, which is a characteristic of the unified sewers designed for the drainage of rainwater, also appears as a limiting factor within the utilities. The larger size of the sewers designed for the drainage of rainwater necessitates the establishment of proportionally larger excavation pits for safe working conditions. Most of the excavation pits necessary for the reconstruction of the inner-city sewers occupy the middle of the road (especially in the case of one-way inner-city streets), in which case the works can be carried out with full road closure only with the approval of the organization responsible for traffic management. The maintenance of the target traffic is expected at every location. Due to the above, the Inviting Authority must organize the works to be carried out at the same time, taking into account the technical necessities, the operational maintenance aspects of the sewer network, and the traffic impacts of the construction works, and consequently, the interventions that can be carried out simultaneously within one main water collection area are expected to be limited to a maximum of three street sections. The reconstruction work of the public sewers must be carried out in accordance with the operating regulations of the Inviting Authority and the relevant legal requirements, other regulations. The procurement of the necessary (road surface removal, public area use or other) permits for the use of the work area concerned with the given task, the submission of the official notifications, is the responsibility of the Participant entitled to the framework agreement (i.e. the winning tenderer selected in the context of the competition reopened for the given construction work). The implementation will be carried out on the basis of the documents of the procurement procedure for the competition reopened for the given construction investment.
