Italy – Truck maintenance services – Procedura aperta sopra soglia comunitaria, ai sensi dell'art. 71 del d.lgs. n. 36/2023 , articolata in n. 4 lotti, per l'affidamento del Servizio di manutenzione degli autocarri attrezzati Rai marca Iveco, Fiat, Mercedes e Renault impiegati nella produzione delle riprese esterne dei CPTV di Roma (lotto 1), Napoli (lotto 2), Milano (lotto 3) e Torino (lotto 4)

Open procedure above the EU threshold, pursuant to Article 71 of Legislative Decree No. 36/2023, divided into 4 lots, for the award of the maintenance service for the equipped trucks Rai brand Iveco, Fiat, Mercedes and Renault used in the production of external shots of the CPTV of Rome (lot 1), Naples (lot 2), Milan (lot 3) and Turin (lot 4). Maintenance service for the equipped trucks Rai brand Iveco, Fiat, Mercedes and Renault used in the production of external shots of the CPTV of Rome, Naples, Milan and Turin, for a duration of 24 months with an option to extend for a further 12 months (maximum duration 24 months). The execution of the service includes the provision of specialised labour, the control and revision of the vehicles, the supply of spare parts for ordinary, extraordinary maintenance and roadside assistance. The Service has been divided into lots applying a geographical criterion for a balance between different objectives: maintaining a logic of territorial continuity for the predominant need connected to an efficient management of the contractual performance and, at the same time, allowing the participation of micro, small and medium-sized enterprises (SMEs) able to modulate their offer in relation to potential specific territorialities. The choice made, configuring a single centre of responsibility in each lot, in fact, makes it possible to guarantee a homogeneous and more efficient governance of the service. There are no participation/ award limits for the lots. Information and clarifications can be requested by no later than 11/09/2026 using the “Communications reserved for the Tenderer” area, present in the detailed area of the procedure. Responses to requests for clarification are provided by publishing the requests in anonymous form and the related responses on the Platform in the “Communications from the Contracting Authority” area. There are no participation/ award limits for the lots. The following types of contractual modification will be envisaged, in all lots: Extension option: the contracting authority reserves the right, pursuant to Article 120, paragraph 10 of the Code, to extend the contract of each lot for a maximum duration of 12 months at the same prices, terms and conditions established in the contract. The estimated amount of this option is € 67,900.00 for lot no. 1; € 39,272.00 for lot no. 2, € 71,961.00 for lot no. 3 and € 26,892.51 for lot no. 4, net of VAT. Variation up to one fifth of the contract amount: if during execution it becomes necessary to increase or decrease the services up to one fifth of the contract amount, the contracting authority, pursuant to Article 120, paragraph 9, of the Code, Rai S.p.A. may impose the execution on the contractor at the originally agreed conditions. In this case, the contractor cannot invoke the right to terminate the contract. Modifications to the contract pursuant to Article 120, paragraph 1, letter a) of the Code. In each lot, the contracting authority Rai S.p.A. reserves the right: - to extend the duration of the contract (base or that resulting from the exercise of the option), if the contractual amount should not be exhausted at the expiry, for the time necessary to use the entire contractual amount; - if the amount initially estimated and indicated in the execution request is not sufficient to cover the number of services actually requested and provided, or if it is overestimated compared to the actual needs, Rai will have the right to vary the amount, increasing or decreasing it, pursuant to Article 120, paragraph 1, letter A, of the Code; - to include or exclude from the contract, in whole or in part, even for limited periods, vehicles that are acquired and/or transferred or enter or exit the legal availability of the contracting authority, without the right of the successful tenderer to any compensation or other form of economic recognition, provided that the consideration for the services regularly performed up to the date of the amendment is paid. In this regard, the successful tenderer takes note and accepts that the Service must be carried out continuously even in the event of possible variations in the composition of the vehicles subject to maintenance. The economic evaluation of such modifications/variants will be made with reference to the contractual consideration; - to make changes to the contract during the period of validity if there are technological deviations in the composition identified within the tender documentation, and in such a case the consideration will be proportionally adjusted, taking into account the incidence of the deviations that have occurred; Modifications to the contract pursuant to Article 120, paragraph 1, letter d) of the Code: in each lot Rai S.p.A. reserves the right, during execution, to replace the initial successful tenderer with a new contractor in the following cases: a) termination of the contract for excessive subsequent onerousness of the performance pursuant to the Civil Code; b) termination of the contract for subsequent impossibility pursuant to the Civil Code. In such circumstances, the replacement may only concern subjects who have participated in the present procedure under the conditions proposed by the economic operator consulted according to the procedures of Article 124 of the Code. In exceptional cases, if the conditions indicated in Article 120, paragraph 11 of the Code occur, the duration of the base contract or that resulting from the exercise of the option, still in execution, may be extended for the strictly necessary time to conclude the procedure for identifying the new contractor. In this hypothesis the original contractor is obliged to perform the contractual services at the prices, terms and conditions provided for in the contract.
