France – Casino operating services – Délégation de service public du casino de Pornichet

Public Service Delegation Contract for a casino, in accordance with Articles L. 1411-1 and following and R. 1411-1 and following of the General Code of Local Authorities and the Order of 14 May 2007, as amended, relating to the regulation of games in casinos. The delegatee will, at its own risk and peril, operate the administrative, technical, commercial, and financial management of the public service of the Casino, using the assets within the scope of the delegation, and will remunerate itself through the operating results of the service, via the revenue received from users. Since the delegator does not have an existing property suitable for accommodating the activities related to the delegated service, the delegatee must propose one or more property solutions to house the Casino of Pornichet. Furthermore, the delegatee will be responsible for operating the following services: - gaming rooms where games directly related to casino activities are operated, - a bar, - a restaurant. The delegatee will be required to implement the investment program proposed by it, as well as the maintenance and renewal of the Casino's equipment. It will be required to implement the means necessary to actively contribute to the tourist, economic, and cultural development of the Commune through a varied and frequent offer of catering and entertainment (entertainment and artistic animation, show programming, etc.) and a management of gambling and money games in accordance with the legislative and regulatory provisions applicable to this sector of activity. The delegatee must ensure the timely acquisition of all administrative authorizations necessary for the exercise of these activities, and in particular the authorization provided for by the Order of 14 May 2007, as amended, relating to the regulation of games in casinos, for a start date of 15 May 2027. The delegatee will remunerate itself through the revenue received from users. No subsidy will be paid to the delegatee as part of the operation of the service. The delegatee will be responsible for: - the tax on the gross gaming revenue, under Article L. 2333-54 of the General Code of Local Authorities. The communal levy rate on the gross gaming revenue will be negotiated with the candidates, - a financial contribution to tourism, sport and culture, - the amounts intended for the Pornichet Municipal Social Action Centre and collected by the casino under the heading "orphans", in accordance with Article 2 of the Order of 29 October 2010 relating to the modalities of collection, recovery and control of specific levies on casino games operated under Articles L. 321-1 and following of the Internal Security Code. The maximum duration of the DSP is set at 20 years. The duration of the contract will be set according to the importance and the duration of the amortization of the investments financed, in particular for the property solution(s) proposed by the delegatee in accordance with Article L3114-7 of the Public Procurement Code. The convention will take effect from 15 May 2027. The estimated value is 9,200,000.00 euros HT per year, or 184,000,000.00 euros HT for the maximum duration of 20 years.
