Description

The subject of the contract is: the provision of comprehensive services in the field of performing the function of a Contract Engineer for the investment entitled Reconstruction and expansion of the wastewater treatment plant in Cedrowice in the direction of increasing its capacity (hereinafter also referred to as the Investment Task). The Contracting Authority has a Feasibility Study and a Technical Specification for the Execution and Acceptance of Construction Works (hereinafter: STWiORB), a Construction Design, a Demolition Design along with the Investor's Cost Estimates for the Investment Task, which supplement the Description of the Subject of the Contract (hereinafter also referred to as OPZ) contained in Annex No. 1 to the SWZ, i.e. Annex No. 1.1. to the SWZ also called Technical Documentation (zip file). The scope of the contract is divided into two stages and includes, in particular: Stage I: 1) preparation, coordination, and supervision of the development of documentation necessary to award a public contract for the subject investment in this Program, including the Functional User Program prepared on the basis of the documents mentioned in point 6.2, together with the detailed scope and form of the executive projects developed by the future contractor of the construction works, hereinafter referred to as the Contractor, in cooperation and agreement with the Contracting Authority (the subject procedure will be, at the request of the Contracting Authority, subject to prior control by the financing unit); 2) comprehensive support of the Contracting Authority in the preparation and conduct of the procedure for construction works, in accordance with the Public Procurement Law and the requirements of FEnIKS2021-2027, in particular with the guidelines, regulations for the selection of projects and conditions related to the operation of FENX.01.03 Water and wastewater management priority FENX.01 Support for the energy and environmental sectors from the Cohesion Fund co-financed from the Cohesion Fund as part of the European Funds for Infrastructure, Climate and Environment 2021-2027, including: a) preparation of procedural documentation, in particular the description of the subject of the contract, required announcements, draft contract clauses, conditions for participation in the procedure, criteria for evaluating offers and other documents necessary to initiate and conduct the procedure, taking into account the inclusion of clauses on meeting the requirements regarding the employment of persons by the contractor or subcontractor on the basis of an employment contract (Article 95 of the Pzp) and requirements regarding the performance of construction works in accordance with the principles of environmental protection; b) preparation of draft responses to contractors' questions, draft changes to procedural documentation, draft invitations, notifications and other correspondence during the procedure; c) participation in the examination and evaluation of offers and preparation of recommendations regarding the selection of the most advantageous offer; d) support of the Contracting Authority in concluding a contract for construction works; e) representation of the Contracting Authority before the National Appeal Chamber or participation in hearings or meetings, if required during the procedure; f) updating the investor's cost estimate and preparation of tender documentation for the contractor of the investment for the reconstruction and expansion of the wastewater treatment plant. 3) The Contracting Authority provides for separate determination of remuneration for Stage I and for Stage II, which will enable the settlement of services provided in Stage I even if, for reasons independent of the Contract Engineer, a contract for construction works is not concluded. 4) The Contracting Authority provides for the requirement of separate determination of remuneration for actions and activities related to the coordination and preparation of tender documentation in Stage I and the requirement of separate determination of remuneration for actions and activities related to comprehensive support of the Contracting Authority in the preparation and conduct of the procedure in Stage I, which will enable the settlement of services provided within the framework of the implemented Project with the Project Implementing Institution (NFOŚiGW), which the Contractor must take into account in the advance settlement, given that the Contracting Authority, when settling individual costs included in the Investment Task, must have knowledge of the detailed expenses. Stage II 5) performance of substantive, technical, administrative-organizational and financial supervision over the implementation of the investment; 6) performance of the function of an investment supervision inspector in the required industries; 7) monitoring the schedule, budget, implementation risks and compliance of the investment with the requirements of FEnIKS 2021-2027; 8) support of the Contracting Authority in the settlement of the investment and preparation of the final project documentation; 9) performance of the tasks of the project coordinator, called the Project Manager, in accordance with the guidelines of the FEnIKS 2021–2027 program, in accordance with the provisions of the Description of the Subject of the Contract. 6.4. The Contracting Authority provides for separate determination of remuneration for Stage I and for Stage II, which will enable the settlement of services provided in Stage I even if, for reasons independent of the Contract Engineer, a contract for construction works is not concluded. 6.5. The Contracting Authority provides for the requirement of determining remuneration for actions and activities related to the performance of substantive, technical and financial supervision in Stage II, the performance of the function of an investment supervision inspector in Stage II and for the remaining actions and activities related to comprehensive support of the Contracting Authority in the administrative-organizational scope in Stage II and in the scope of monitoring the schedule, budget, implementation risks and compliance of the investment with the requirements of FEnIKS 2021-2027 in Stage II, in the scope of supporting the Contracting Authority in the settlement of the investment and preparation of the final project documentation in Stage II, in the scope of performing the tasks of the Project Coordinator called the Project Manager in Stage II, which will enable the settlement of services provided within the framework of the implemented (...)
