The subject of the contract is the performance of winter maintenance works on roads and pavements within the road corridor in the city of Bytom, divided into parts with the possibility of applying options. 2. The subject of the contract is divided into parts: 1) Part 1: Communication routes. 2) Part 2: Strict Centre, Centre, North City Centre, West City Centre. 3) Part 3: Miechowice, Karb, Stroszek, Sucha Góra, Stolarzowice, Górniki. 4) Part 4: Rozbark, Łagiewniki, Szombierki, Bobrek. 3. The complex of parts covered by the contract in each part for the basic scope and optional scope constitutes the fulfilment of obligations related to maintaining cleanliness and order on the road corridors of public and internal roads within the administrative boundaries of the city of Bytom, imposed on the Contracting Authority in accordance with art. 5 para. 1 point 4), para. 4 and 5 of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2025 item 773). 4. The subject of the contract and the manner of its implementation in each part is specified by: a) Detailed Description of the Subject of the Contract (hereinafter SOPZ) - Annex No. 1 to SWZ b) Estimated quantities - Annex No. 1.1 – 1.4 to SWZ c) Lists of areas - Annex No. 1.5 – 1.8 to SWZ d) Snow clearing scheme of the Market Square - Annex No. 1.9 to SWZ e) Draft contract terms - Annex No. 2 to SWZ. 5. The Contracting Authority allows for the submission of partial offers in relation to 4 parts of the procedure. 6. An offer can be submitted for 4 parts. 7. The Contracting Authority does not limit the number of parts of the contract that can be awarded to one Contractor. 8. The Contracting Authority does not require the submission of an offer in the form of an electronic catalogue. 9. The Contracting Authority did not conduct preliminary market consultations before initiating the procedure. 10. The Contracting Authority does not envisage variant offers. 11. The Contracting Authority allows for the possibility of invalidating the procedure if the public funds that it intended to allocate for the financing of the whole or part of the contract have not been granted to it. 12. Requirements regarding the submission of an offer by contractors jointly applying for the award of the contract: Pursuant to art. 58 of the Pzp Act, Contractors may apply jointly (consortia, civil partnerships). In the event that Contractors apply jointly for the award of the contract, the Contractors appoint a representative to represent them in the procedure for the award of the contract or to represent them in the procedure and conclude a contract in the matter of a public contract (the above does not apply to a civil partnership, if the Contractors attach to the offer a civil partnership agreement, from which the power of attorney to act on behalf of the partnership will result, or all partners sign the offer). In matters not regulated by SWZ, the provisions of the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on the subject of the personal means of evidence and other documents or declarations that the Contracting Authority may require from subcontractors (Journal of Laws of 2020, item 2415) shall apply. 13. The public contract is included in the plan of procedures for the award of contracts 2026 published in the Bulletin of Public Procurements on 14.01.2026 No. 2026/BZP 00034354/01/P - item 2.3.2. 14. The Contracting Authority envisages the award of contracts consisting of the repetition of similar services, as mentioned in art. 214 para. 1 point 7 of the Pzp Act. 16. The Contracting Authority conducts the procedure independently. 17. The announcement does not concern a contract for social services and other special services. 18. The Contracting Authority does not envisage the requirements referred to in art. 94 pzp. 19. The Contracting Authority does not envisage subject-specific means of evidence. 20. PERSONAL DATA PROTECTION The Contractor declares that it meets the requirements specified in art. 28, 29, 30, 32, 33 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27.04.2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, in particular: a) ensures that it applies technical and organisational measures ensuring the security of the personal data transmitted, b) ensures that access to the personal data entrusted is only for persons authorised by the Contractor, to whom the Contractor has entrusted the processing of personal data, c) ensures that access to the premises where the entrusted data is processed is only for persons authorised to do so and that access to these premises is monitored, d) ensures that the systems, applications and IT equipment used to process the entrusted data are secured against unauthorised disclosure or loss of the entrusted data, e) ensures that the remote access connection to the IT system is secured by an encrypted channel, f) ensures that it will cooperate with the administrator to implement the rights of the data subjects, as indicated in Chapter III of the aforementioned Regulation, g) ensures that it will immediately inform the administrator of any personal data breaches, and also cooperate with the administrator to the extent necessary to fulfil the obligations related to the personal data breach incumbent on the administrator under the aforementioned Regulation. The Contractor declares that it maintains documentation confirming the performance of the above actions and that, upon request of the administrator, it will provide the indicated documentation.
