Poland – Environmental engineering consultancy services – Pełnienie funkcji Eksperta Przyrodnika prowadzącego nadzór przyrodniczy nad zadaniem pn. „Opracowanie dokumentacji technicznej i projektowo-kosztorysowej oraz realizacja prac wykonawczych i robót budowlanych dla przedsięwzięcia polegającego na remoncie grobli hydrotechnicznej.

I. 1.1.1. The subject of the contract is: performing the function of a Naturalist Expert conducting natural supervision of the task entitled “Preparation of technical and design-and-estimate documentation and the implementation of construction and construction works for the project involving the repair of a hydrotechnical dike”. 2. The subject of the contract has been divided into 2 Parts: Part I - Performing the function of a Naturalist Expert conducting natural supervision of the task (hereinafter, “task”) entitled “Preparation of technical and design-and-estimate documentation and the implementation of construction and construction works for the project involving the repair of a hydrotechnical dike located on the fish pond Lekacz within the Natura 2000 area Stawy w Brzeszczach PLB120009” Part II - Performing the function of a Naturalist Expert conducting natural supervision of the task (hereinafter, “task”) entitled “Preparation of technical and design-and-estimate documentation and the implementation of construction and construction works for the project involving the repair of a hydrotechnical dike located on the fish ponds Olszowiec, Granicznik and Zieleńszczak within the Natura 2000 area Dolina Dolnej Soły PLB120004” 2. The details of the scope of the subject of this contract are specified in Annex No. 9 and 9a to SWZ – Description of the Subject of the Contract (OPZ). 3. Contract value: - Part I 16 331,22 PLN - Part II 16 331,22 PLN

II. The tender must be submitted, under penalty of invalidity, in electronic form, i.e. in the form of an electronic document with a qualified electronic signature.

III. 1. Documents submitted by the contractor together with the tender: 1) completed Tender Form (Annex No. 1 to SWZ). If the Contractor wishes to obtain additional points in the second tender evaluation criterion - completed list of additional expert experience (Annex No. 1A to SWZ); 2) power of attorney or other document confirming the authority to represent the contractor – if the tender or statements or documents attached thereto are signed by a proxy. 3) Power of attorney to represent all Contractors jointly applying for the contract, or alternatively a cooperation agreement, from which the subject power of attorney will result. 4) JEDZ (in accordance with the instruction from Annex No. 2 to SWZ), valid on the date of submission of tenders, for the purpose of temporary confirmation that the Contractor is not excluded from the procedure on the basis of art. 108 para. 1 and art. 109 para. 1 point 4 of the Pzp Act and meets the conditions for participation in the procedure specified in the SWZ. In the case of joint application for the contract by Contractors, JEDZ is submitted by each of the Contractors jointly applying for the contract; 5) JEDZ relating to other entities, on whose resources the Contractor relies, for the purpose of temporary confirmation, valid on the date of submission of tenders, of the absence of grounds for exclusion on the basis of art. 108 para. 1 and art. 109 para. 1 point 4 of the Pzp Act and the fulfilment of the conditions for participation in the procedure specified in the SWZ, to the extent to which the Contractor relies on their resources; 6) a declaration by the Contractor, valid on the date of submission of tenders, for the purpose of confirming that the Contractor is not excluded from the procedure on the basis of art. 5k of Council Regulation (EU) 2025/2033 and art. 7 para. 1 of the Act on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, in accordance with the template constituting Annex No. 8 to SWZ. In the case of joint application for the contract by Contractors, the declaration is submitted by each of the Contractors jointly applying for the contract; 7) a declaration by another entity, on whose resources the Contractor relies, submitted for the purpose of confirming, valid on the date of submission of tenders, that the entity is not excluded from the procedure on the basis of art. 5k of Council Regulation (EU) 2025/2033 and art. 7 para. 1 of the Act on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, in accordance with the template constituting Annex No. 8 to SWZ; 8) in the event that the Contractor relies on the capabilities or situation of entities providing resources: evidence confirming that the Contractor, when implementing the contract, will have the necessary resources of other entities, which in particular constitutes the obligation of these entities to make the necessary resources available to the Contractor for the purpose of implementing the contract or another evidential means confirming that the Contractor, when implementing the contract, will have the necessary resources of these entities. 9) a declaration by the Contractors jointly applying for the contract, from which it results which supplies or services will be performed by the individual Contractors, in accordance with the template constituting Annex No. 7 to SWZ (if applicable);

V. The Contractor is excluded from the procedure for the award of the contract, with the reservation of art. 110 para. 2 of the Pzp Act, on the basis of: art. 108 para. 1 of the Pzp Act, art. 109 para. 1 point 4 of the Pzp Act and on the basis of: art. 5k of Council Regulation (EU) 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, added in art. 1 point 23 of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine together with Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (hereinafter: Regulation 2025/2033), and art. 7 para. 1 of the Act of 13 April 2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security... hereinafter SWZ.
