Poland – Electricity, heating, solar and nuclear energy – Dostawa energii elektrycznej dla Miasta Chełm i jednostek organizacyjnych

1. The subject of the contract is the supply of electrical energy to the Contracting Authority's points of electricity consumption, in accordance with the provisions of the Law of 10 April 1997 on Energy Law (consolidated text: Journal of Laws of 2026, item 43, as amended), hereinafter referred to as the "Energy Law", and the executive acts issued thereon, with the specified quality standards. The quality standards for electrical energy are described in the Energy Law, in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the functioning of the power system (consolidated text: Journal of Laws of 2025, item 919, as amended), and in the Regulation of the Minister of Energy of 3 September 2026 on the method of shaping and calculating tariffs and the method of settlements in the trade of electrical energy (Journal of Laws of 2026, item 1182). 2. A detailed description of the subject of the contract, as well as the requirements and principles of contract implementation, are specified in the Draft Contract Terms constituting Annex No. 3 to the SWZ, together with the list of points of electricity consumption constituting Annex No. 2 to the SWZ. 3. In the event that the Contracting Authority installs renewable energy sources (RES) during the term of the Contract, the Contractor shall be additionally obligated to purchase/settle the surpluses of electrical energy generated in the RES installations, which has been introduced into the appropriate local OSD power grid.
