Poland – Natural gas – Świadczenie kompleksowej sprzedaży i dystrybucji / przesyłu paliwa gazowego do placówek Zespołu Żłobków m.st. Warszawy.

The subject of the contract is the comprehensive sale and distribution/delivery of natural gas to the facilities of the Kindergarten Group of m.st. Warsaw. The list of facilities and data related to the facilities are in Annex No. 3.2 to SWZ. The price calculation is in Annex No. 3.1 to SWZ. 3. The contractor undertakes to supply natural gas of group E at a pressure not lower than 1.6 kPa to the installations located in the aforementioned facilities and to transfer to the Buyer the ownership of the supplied natural gas. 4. The quality standards of the natural gas have been described in §38 and 43 of the Regulation of the Minister of Economy of 2 July 2010 on the detailed conditions for the functioning of the gas system (i.e. Journal of Laws of 2025, item 1382, as amended), which was issued on the basis of art. 9 para. 1 and 2 of the Act of 10 April 1997 - Energy Law (Journal of Laws of 2026, item 43), while the conditions for the implementation of the contract result from the contract documents. 5. The forecast demand for natural gas of the individual facilities covered by the contract is indicated in Annex No. 3.1 (Price Calculation) and 3.2 (PPG data) to SWZ. The forecast demand for natural gas indicated by the Buyer in Annex No. 3.1 and 3.2 to SWZ is of an estimated nature and does not constitute an obligation on the part of the Buyer to purchase natural gas in the specified quantity. In the event of a difference between the planned and actual consumption, the Contractor will not claim financial claims other than those resulting from the quantity of natural gas consumed. The estimated consumption of natural gas serves solely for the comparison of offers in the evaluation criterion: price. 6. The Buyer declares that it is NOT a gas intermediary entity (within the meaning of the Excise Duty Act). 7. The Buyer declares that the natural gas taken up on the basis of this contract is intended for heating purposes for the kindergartens mentioned in the Act of 4 February 2011 on the care of children up to the age of 3 (declaration for the purposes of excise duty assessment). 8. The Buyer informs that all the Buyer's facilities are covered by a comprehensive gas sale and distribution agreement with myOrlen Sp. z o.o. – the agreement is valid until 31.12.2026. 9. The Contractor will be obliged to implement the subject of the contract in accordance with the projected provisions of the agreement, which are Annex No. 9 to SWZ.
