The subject of the contract is the supply of electricity for the period from 01.01.2027 to 31.12.2028. The subject of the contract has not been divided into parts. The contracting authority does not allow the submission of partial tenders. Reasons for not dividing the contract: The implementation of the contract by several entities could contribute to a reduction in the quality standards of the delivered supply, be associated with a limitation of competition or technical difficulties or excessive costs of contract execution. Moreover, it would be difficult to control the execution of the contract, the expenditure of funds in the case of Contracts concluded with several Contractors for the same subject of the contract, in a situation where different unit prices for electricity applied for individual tariff groups. Moreover, by conducting one tender, the contracting authority may obtain more favourable price conditions than by conducting a tender procedure for each point of delivery separately. 2. A detailed description and the method of contract implementation is contained in the OPZ, which is Annex No. 8 to the SWZ and the draft contract provisions which are Annex No. 5 to the SWZ. 3. The contracting authority does not allow the submission of variant tenders or in the form of electronic catalogues. 4. The contracting authority does not envisage the awarding of contracts, as referred to in Article 214(1)(8) of the Public Procurement Law. 5. Requirements set for the contractor related to the execution of the contract: − The contractor is responsible for the quality and compliance with the technical and quality conditions described for the subject of the contract; − Due diligence is required in the performance of obligations arising from the public contract award; − The contractor has the obligation to indicate in the JEDZ the parts of the contract, the execution of which will be entrusted to subcontractors.
