Description

The subject of the contract is the collection and disposal of waste with code 19 12 12 – i.e. Other waste (including mixed substances and objects) from mechanical processing of waste other than those mentioned in 19 12 11) from Zakład Gospodarki Odpadami S.A. in Bielsko-Biała. Waste with code 19 12 12 arises from the processing of municipal waste at the Contracting Authority's facility and, as a "ballast" fraction not containing materials suitable for material recovery, should be subjected to other recovery or neutralization processes, in accordance with Annex No. 1 and 2 to the Waste Act of 14 December 2012 (Dz. U. 2023 r. poz. 1587 ze zm.). Waste with code 19 12 12 intended for recovery or neutralization will come from the process of sorting mixed municipal waste and municipal waste from selective collection. The process of treating the above waste involves its mechanical and manual sorting into several material fractions on an automated sorting line. As a result of this process, in addition to the so-called secondary raw material fractions and so-called pre-RDF, a "ballast" fraction with a granulation of 0-80 mm (from selectively collected waste) and 80 mm to above 300 mm (from mixed and selectively collected waste) is produced, which can be subjected to energy recovery or other forms of recovery/neutralization. These wastes will be handed over to the Contractor in bulk. The method and place of disposal of the collected waste must be in accordance with the applicable legal provisions, in particular with the requirements of the above-mentioned Waste Act and its implementing regulations. The collection of waste will take place from Monday to Friday from 6:00 to 18:00 /or hours agreed with the Contractor previously established by email by the Contractor with the representative of the Contracting Authority. The Contractor will agree with the representative of the Contracting Authority no later than the day before the waste collection is carried out the planned time of waste collection. The agreement will be confirmed by sending an advice note containing: the time of arrival of the vehicle, the registration numbers of the tractor and trailer, the BDO number of the transporter together with the business activity number of the BDO taking over the waste. In the event of incomplete advice note in the above deadline, the Contracting Authority reserves the right not to issue the waste and to charge contractual penalties in accordance with the provisions of the Agreement. The weighing of the waste collected by the Contractor will take place on the legalized scales of the Contracting Authority (located at the Contracting Authority's facility). The reading from the Contracting Authority's scale will be the sole basis for determining the quantity of waste collected between the Contracting Authority and the Contractor. Documents related to the transfer of waste will be issued in accordance with the requirements of the law in this regard. The document constituting the basis for issuing VAT invoices is the confirmation of the acceptance of waste by the Contractor on the waste transfer card generated in the BDO system. The Contracting Authority is responsible for loading waste with code 19 12 12. The Contracting Authority will enable the Contractor (on a written request) to take samples of the waste items for the purpose of carrying out their own tests in the scope of quality parameters such as: calorific value, moisture, chlorine, sulfur content and others. The Contractor will be obliged to prepare and submit to the Contracting Authority information on the method of waste disposal in accordance with Annex No. 1 or 2 of the Waste Act together with the process symbol (R_ or D_), name, address and business activity number (BDO), in which the waste was finally disposed of, after the end of each calendar month, in which its collection will take place and within 5 days after the last collection of waste. The estimated quantity of waste that will be handed over to the Contractor during the validity of the Agreement will be 11,700 Mg. The Contracting Authority reserves that the given quantity is an estimated value, reflecting the possible size of the scope of the contract. The Contracting Authority specifies the minimum quantity of the subject of the contract in the amount of 6,000 Mg. This quantity may change in the event of circumstances beyond the control of the Contracting Authority. THE CONTRACTING AUTHORITY REQUIRES THE CONDUCT OF A LOCAL VISIT TO THE FACILITY.
