Romania – Marine patrol vessels – Achiziţie navă maritimă de patrulare costieră

The contracting authority is procuring a coastal patrol vessel. Pursuant to art. 221 (1) lit. a) of Law No. 98/2016 on public procurement, the contracting authority uses contract review clauses in the procurement procedure as follows: A. Contract review clause regarding the replacement of offered products with state-of-the-art products. The contracting authority specifies that it will use the review clause for the delivery of state-of-the-art products in the event that the manufacturer of the initially offered products has declared, during the contract validity period, that the initially offered products are end-of-sale/end-of-life/end-of-support. This clause includes all equipment on board the vessels. Upon application of the review clause, the contract value will not be modified, and the replacement proposals will be analysed by the contracting authority to ensure that the technical specifications of the newly proposed products are equivalent to or superior to the technical specifications of the initially offered products. The procurement will be funded from non-repayable external funds under the call BMVI/2023-2024/SA/1.2.2 as well as from the allocations of the National Programme 2021-2027 Border Management and Visas / state budget, according to the information letter received from the funder no. AM26/1011132/07.05.2026. Clarification requests related to the award documentation will be submitted only through SEAP (https://e-licitatie.ro), by accessing the dedicated section "Questions" from the details of the ongoing award procedure. The contracting authority will respond clearly and completely to all clarification requests/information requests by the 11th day before the deadline for submission of tenders, provided that these requests have been submitted within the period mentioned in SECTION I, i.e. 19 days before the deadline for submission of tenders. To comply with the principle of equal treatment, interested economic operators will respect the provisions of the ANAP notification no. 247 regarding the method of transmitting clarification requests and additional information to the award documentation / responses formulated in the event of conducting public procurement contract award procedures through electronic means (on-line), in the sense that the documents attached to the "Questions" section WILL NOT CONTAIN THE IDENTIFICATION DATA OF THESE, since they will become public at the time of transmission of the response by the contracting authority!
