Purchasing and servicing 5 compact tractors and adapters (5 dump trailer lifts, 5 snow ploughs, 5 salt spreaders, 5 front weight attachments, 1 front loader) for 48 months. BT-300 field, continuation of point VI.3): 26) The bidder must declare in the bid the restrictive measures imposed by the 833/2014/EU regulation, amended by 2022/576 EU regulation, article 1, paragraph 23, in relation to the prohibition under article 5k of the 833/2014/EU regulation, due to the restrictive measures imposed by the Russian measures destabilizing the situation in Ukraine. 27) The contracting authority draws the attention of the bidders to the fact that the following will be recorded in the contract draft made available: The parties declare that they are aware of the COVID-19 pandemic, as well as the Russian-Ukrainian war and the restrictions, obstacles, and supply difficulties related thereto at the time of contracting, that they do not consider the state of the contract at the time of its conclusion to be force majeure or an impediment to performance, a circumstance that directly or indirectly affects the performance of the contract or the provision of services and counter-services as stipulated in the contract, or a reason for modifying the contract. 28) The bidder must indicate in the bid the reason(s) for the service(s) in Hungary (located in Budapest or within a 30 km radius), the list of brand service(s) where the mandatory maintenance services (maintenance) will be carried out during the mandatory warranty period and – during the entire warranty period – the repairs covered by the warranty. 29) The bidder must declare in the bid that spare parts supply will be ensured during the 48-month warranty period. 30) The contracting authority prescribes as a condition of contract award that the winning bidder must submit by the time of contract award the manufacturer's or manufacturer's representative's proof that - they are entitled to submit a bid for the tractors and adapters offered for use in Hungary, - and that the manufacturer's support for the tractors and adapters sold by them in Hungary is provided without restriction, - and must attach the valid type-approval certificate for the tractors, which complies with the current EU and national legislation, - and a declaration on this must also be made in the bid. The contracting authority considers the failure to provide the above document(s) as a withdrawal from the contract award by the winning bidder, according to Kbt. 131.§(4). 31) The bidder must attach to the bid: – a company declaration that the tractors delivered will comply with the 5/1990. (IV. 12.) KöHÉM decree (on the technical inspection of road vehicles), the 6/1990 (IV.12) KöHÉM decree (on the technical requirements for the placing on the market and keeping in service of road vehicles), the valid provisions of the 1993. évi XCIII. law; as well as the MSZ EN ISO 12100 and MSZ EN 13524 standards. - a company declaration that the tractors and adapters offered by them are new.
