Poland – Natural gas – Kompleksowa dostawa gazu ziemnego wysokometanowego typu E do obiektów PANS w Jarosławiu

1. The subject of this order is the COMPLEX SUPPLY OF HIGH-CALORIFIC NATURAL GAS TYPE E TO THE PANS OBJECTS IN JAROSŁAWIE, indicated in Annex No. 3 to the SWZ for the period from 01.01.2027 to 31.12.2027. The supply of gas will be carried out based on a contract containing the provisions of the sales contract and the contract for the provision of services for the transmission or distribution of gas (complex contract). 2. The quantities given in Annex No. 2 and Annex No. 3 to the SWZ are estimated quantities of consumption determined based on consumption in 2025, increased by any increased consumption in order to determine the quantity of the order, which does not reflect the real or declared use of gaseous fuel for the period from 01.01.2027 to 31.12.2027. The demand for natural gas was accepted for the calculation of the estimated value of the order, which may differ from the actual use of natural gas and in no way can be the basis for any claims from the Contractor. The forecasted gas consumption has an indicative character, as it is not possible to determine in advance the quantity that will be delivered to the Orderer and does not constitute an obligation on the part of the Orderer to purchase natural gas in the stated quantity. 3. The supplied natural gas should meet the legal requirements and technical parameters in accordance with the provisions of the Act of 10 April 1997 on Energy Law (i.e. Journal of Laws of 2026, item No. 43) and the executive acts issued on its basis as well as the Act of 16 February 2007 on oil, petroleum product and natural gas reserves and the rules of procedure in situations threatening the security of the country's fuel supply and disruptions on the oil market (i.e. Journal of Laws of 2026, item No. 599). 4. The Contractor undertakes to carry out the procedure for changing the supplier of gaseous fuels, in accordance with the Instruction for the Operation and Exploitation of the Distribution Network (IRiESD) in the scope of providing and using gas fuel distribution services. The Contractor, with whom the contract will be concluded, in accordance with art. 4 of the Energy Law, will inform the current operator of the transmission system and the operator of the distribution system no later than 21 days before the start of the order implementation about the conclusion of a complex contract with a new supplier. 5. The Orderer has a complex Agreement for the supply of gaseous fuel to all receiving points with myORLEN Sp. z o.o. with its registered office in Warsaw at ul. Jana Kazimierza 3, 01-248 Warsaw, valid until 31.12.2026. 6. The price in the price form should include excise tax if it concerns the University. 7. The Orderer is connected to the network of the distributor Polska Spółka Gazownicza with its registered office in Jaśle, Tarnowski Tariff Area. 8. The estimated consumption of natural gas in the period 01.01.2027 to 31.12.2027 is estimated at: 2,889,270 kWh. The estimated monthly gas consumption and the list of points with estimated consumption are contained in Annex No. 2 and 3 to the SWZ.
