Poland – Refuse and waste related services – Kompleksowe odbieranie i zagospodarowanie odpadów komunalnych z nieruchomości na terenie Gminy Brzeszcze wraz z obsługą PSZOK na terenie Gminy Brzeszcze

The subject of the contract is the comprehensive provision of services including the collection, transport and disposal (recovery or neutralisation) of the indicated fractions of municipal waste from the owners of properties where residents live within the administrative boundaries of the Municipality of Brzeszcze, as well as the organisation, maintenance and current operational service of the stationary Selective Waste Collection Point (PSZOK) located in the municipality. The detailed description of the subject of the contract is Annex No. 13 – Description of the Subject of the Contract and Annex No. 12 – Contract Template for SWZ. 2. PERSONAL DATA PROTECTION COLLECTED BY THE CONTRACTING AUTHORITY - information has been described in detail in SWZ p. 3. 3. The contractor will not be obliged to provide security for the proper performance of the contract before the contract is signed. 4. The contracting authority does not require the submission of evidence with the offer. 5. CONTRACTORS APPLYING JOINTLY FOR THE AWARD OF A PUBLIC CONTRACT. 1) Contractors applying jointly for the award of a public contract (consortium, civil partnerships) will be jointly and severally liable for the non-performance or improper performance of the obligation arising from the subject of the awarded contract; 2) The same contractor may be a member of only one consortium. 3) Contractors may apply jointly for the award of a public contract. In such a case, the contractors acting jointly are obliged to appoint a representative to represent them in the procedure or to represent them in the procedure and conclude the contract in the matter of the subject of the public contract. All correspondence will be conducted by the contracting authority exclusively with the representative. 4) The condition regarding the entitlement to carry out a specific economic or professional activity (if formulated), referred to in art. 112 (2) (2) of the Pzp Act, will be met if at least one of the contractors applying jointly for the award of the contract has the entitlement to carry out a specific economic or professional activity and will provide the services for which these entitlements are required. 5) With regard to conditions relating to education, professional qualifications or experience (if formulated), contractors applying jointly for the award of the contract may rely on the abilities of those contractors who will provide the services for which these abilities are required. 6) In the case referred to in paragraphs 4) and 5), contractors applying jointly for the award of the contract shall attach to the offer a declaration indicating which services will be provided by the individual contractors. 6. GROUNDS FOR EXCLUSION. The contracting authority will exclude from the procedure contractors in respect of whom the grounds for exclusion exist: - referred to in art. 108 (1) of the Pzp Act, - in respect of whom the grounds for exclusion exist, referred to in art. 7 (1) of the Act of 13 April 2022 on special solutions to counter the support of aggression against Ukraine and serving to protect national security, - in respect of whom the grounds for exclusion exist, referred to in art. 5k) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.7.2014, p. 1), hereinafter: Regulation 833/2014, in the wording given by Council Regulation (EU) 2025/2033 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L, 2025/2033, 23.10.2025).
