Poland – Snow-clearing services – Zimowe oczyszczanie dróg gminnych na terenie Dzielnicy Praga-Południe m.st. Warszawy w sezonach 2026/2027, 2027/2028, 2028/2029, 2029/2030

1. The subject of the contract is the winter maintenance of municipal roads in the Praga-Południe District of Warsaw for the 2026/2027, 2027/2028, 2028/2029, 2029/2030 seasons. The contract includes the following works: a) ploughing – snow removal, ensuring road passability and allowing pedestrians to use the roads, in conditions of snowfall above 5 cm, b) spreading appropriate chemical agents, in accordance with the Regulation of the Minister of the Environment of 27 October 2005 on the types and conditions of use of substances that can be used on public roads as well as streets and squares (Journal of Laws 2005 No. 230 item 1960), on the road surface and/or pedestrian paths in doses adapted to the needs and weather conditions, c) eliminating slipperiness from the road surface and/or pedestrian paths by manual and mechanical sanding, d) clearing and removing snow and/or ice according to the instructions of the Contracting Authority, e) collecting and disposing of slush, snow, ice and other contaminants from the road surface and pedestrian paths, f) emergency ploughing, spreading chemical agents and/or sand, eliminating slipperiness, collecting and disposing of slush, snow, ice and other contaminants from cycle paths, g) manual and/or mechanical sweeping of sand used to remove slipperiness from the road surface and/or pedestrian paths, h) manual and/or mechanical sweeping of the road surface and pedestrian paths at the end of the season, i) emergency manual and/or mechanical sweeping of sand at the end of the season from cycle paths not being a carriageway, j) managing the resulting waste. 2. A detailed description and scope of the works is specified in the Subject of the Contract Description (OPZ) which is Annex 13 to the SWZ. 3. Additional obligations of the Contractor resulting from the social clause pursuant to Article 95(1) of the Public Procurement Act, the Contracting Authority requires that the Contractor or Subcontractor employs, for the entire period of contract execution, based on an employment relationship, in accordance with Article 22(1) of the Act of 26 June 1974 on the Labour Code (Journal of Laws 2026 item 1245), workers directly performing tasks related to the execution of the contract, including: work related to winter maintenance of pavements, carriageways and emergency cycle paths. The above condition will be met by employing new workers/employee under an employment contract or assigning workers/employee already employed by the Contractor or Subcontractor to execute the contract. Detailed requirements are specified in §17 of the Contract Template – Annex 12 to the SWZ. 4. Right of option – additional scope of services 1. Within the execution of the contract, the Contracting Authority is entitled, pursuant to Article 441 of the Public Procurement Act, to instruct the Contractor to perform additional work resulting from the Right of Option, as defined in Annex 14 to the SWZ (Annex 2a to the contract). 2. The Contracting Authority is not obliged to exercise the Right of Option. Non-exercise of the Right of Option does not constitute a breach of contract or improper performance of the contract. The Contractor has no claim for its performance. The Contractor agrees to the above. 3. The Contracting Authority will submit a declaration of exercising the Right of Option in accordance with the content of Annex 2b to the contract in the event that such a need arises and when it has the funds to finance the contract within the scope covered by the Right of Option and during the validity of the contract. 4. In the event of non-exercise by the Contracting Authority of the Right of Option in full, the Contractor will be entitled to remuneration only for the works ordered and performed.
