Description

The subject of the contract is the supply of electricity and the purchase of electricity generated in renewable energy sources installations belonging to the Contracting Entities, carried out in accordance with the Energy Law, the Renewable Energy Sources Act, applicable implementing regulations and quality standards for customer service. The detailed list of power take-off points, RES installations and the forecast volume of electricity covered by the contract is contained in Annex No. 2 to the SWZ – "Description of the Subject of the Contract EE 2027-2028".

2. The subject of the contract includes: 1) supply of electricity to the Contracting Entities' power take-off points, 2) purchase of electricity generated and fed into the grid from the Contracting Entities' RES installations, 3) settlement of electricity according to four groups of recipients specified in the table below, for which the Contractor is obliged to offer separate unit prices for electricity valid respectively in 2027 and 2028.

Group 4 Objects powered from the Gxx tariff group All remaining objects not included in Group 1-3 belonging to the OSD tariff groups: Gxx

3. The forecast demand for electricity in the period from 01.01.2027 to 31.12.2028, with a breakdown by tariffs, has been determined in the excel file marked: "Description of the Subject of the Contract EE 2027-2028"; sheet "Volume".

4. Purchase of electricity generated in RES installations 1) The contract also includes the receipt and settlement of electricity fed into the distribution network from renewable energy sources installations belonging to the Contracting Entity; 2) The Contractor will be obliged to enter into an agreement with the Contracting Entity regulating the rules for the purchase of electricity fed into the grid, in accordance with the requirements specified in this SWZ and Annex No. 5a) to the SWZ "Minimum requirements for the electricity purchase agreement"; 3) The Contractor is obliged to prepare a project of the electricity purchase agreement meeting the requirements specified in the SWZ and Annex No. 5a to the SWZ; 4) The method of settling electricity fed into the grid will depend on the legal status of a given RES installation and the applicable legal provisions.

5. Detailed conditions for the implementation of the contract The Contracting Entity has specified in the draft provisions of the contract, constituting Annex No. 5 to the SWZ – PPU.

6. Electricity distribution services will be provided on the basis of separate agreements concluded between individual Contracting Entities (recipients/payers) and the relevant distribution system operator (OSD).
