The subject of the procedure is the conclusion of framework agreements for the supply of network switches, hereinafter referred to as the assortment. 2. The detailed description of the subject of the order is Section XIX/XIXa SWZ and Annex No. 5 to SWZ. 3. The Purchaser requires the Contractor to offer a minimum guarantee period of 24 months and a warranty period, calculated from the date of signing the protocol of quantitative acceptance of the delivery. The warranty period may not be shorter than the guarantee period. 4. The Purchaser does not require the submission of evidential means with the offer. 5. The Purchaser requires the indication in the price form (col. 5 of the table of Annex No. 6 to SWZ) of the producer, model, type, symbol or other data uniquely identifying the offered assortment. In the event of failure to indicate in the offer data uniquely identifying the offered assortment or failure to submit Annex No. 5 to SWZ with the offer, the Purchaser will reject the offer on the basis of Article 226(1)(5) of the Act. The term "producer" shall be understood to mean the name of the company under which the offered assortment is sold, or the entrepreneur introducing the goods into circulation on the territory of the Republic of Poland. 6. The Purchaser requires that the offered ICT products do not include: 1) ICT products indicated in the recommendation referred to in Article 34(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of the security of the State; 2) an ICT product, the type of which has been determined in a decision on the recognition of a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system; Non-compliance with the above requirement will result in the rejection of the offer on the basis of Article 226(1)(17) or (19) of the Public Procurement Law (i.e. Journal of Laws of 2026, item 793 as amended). 7. The trademarks, patents or origin, sources or special process, which characterise the products or services supplied by a specific contractor, referred to in Article 99(4) of the Act, and the standards, European technical assessments, approvals, technical specifications and technical reference systems, referred to in Article 101(4) of the Act, used by the Purchaser in this documentation, constitute only a quality, functional, technical, technological or aesthetic model and in all cases of their use, the use of materials, devices, technical systems and other equivalent elements, hereinafter referred to as "equivalent solutions", is permitted. Defined materials, devices, technical systems and other elements described using "limiting formulations" may be replaced by equivalent solutions with appropriately not worse technical, technological, aesthetic and quality or functional characteristics described in this documentation. The use of "limiting formulations" does not aim to prefer a given producer or his product, but serves only to indicate a solution that should have properties and characteristics not worse than those indicated in this documentation. The Purchaser will verify offers containing equivalent solutions in terms of compliance with the requirements of the individual items of requirements contained in this documentation. The Contractor is obliged to prove the equivalence of the offered materials in the offer. The Purchaser will not recognise the offered solutions as equivalent if they have worse properties or characteristics than those indicated in this documentation. 8. The Purchaser does not allow partial offers to be submitted. 9. The Purchaser allows the performance of part of the order to be entrusted to a Subcontractor. 10. The Purchaser requires the Contractor to indicate in the offer the part of the order, the performance of which will be entrusted to Subcontractors, and to provide the names of any Subcontractors, if they are already known. 11. The order completion deadline: no longer than 180 working days, calculated from the date of conclusion of the performance contract or acceptance of the requirement. 12. The procedure for awarding orders on the basis of framework agreements is described in Section XIX/XIXa SWZ. 13. In the event that, as a result of the subject procedure, an agreement is concluded with one Contractor, the Purchaser will award a public order on the basis of Article 313 of the Act, i.e. on the basis of a framework agreement, the model of which is Annex XIXa to SWZ. 14. The type and scope of the changes to the agreement are indicated in Section XIX/XIXa SWZ. 15. The Contractor is bound by the offer for 90 days from the expiry of the offer submission deadline, with the first day of being bound by the offer being the day on which the offer submission deadline expires, i.e. until 30.12.2026. 16.
