The subject of the contract is: "Year-round (current and winter) maintenance of national roads administered by the General Directorate of National Roads and Motorways, Rzeszów Branch, divided into 4 parts: Part 1 – maintenance of national roads in the Przemyśl District - motorway A-4 from Rzeszów East (without junction) to Jarosław West (with junction) Part 2 – maintenance of national roads G, GP in the Przemyśl District Part 3 – maintenance of national roads G, GP in the Lesko District Part 4 – maintenance of national roads G, GP and S in the Nisko District". The Contracting Authority allows the submission of partial offers in accordance with the division of the subject of the contract specified in point 6.1. IDW SWZ. Pursuant to Article 91(1) of the Pzp Act, the Contracting Authority specifies that one Contractor may submit an offer for a maximum of two arbitrarily chosen parts of the contract. The subject of the contract includes the performance for Part 1 from 01.05.2027 to 30.04.2031, and if the contract is signed after 01.05.2027, it will be valid from the date of the protocol handover of the roads for maintenance to 30.04.2031, for Part 2 from 01.09.2027 to 31.08.2031, and if the contract is signed after 01.09.2027, it will be valid from the date of the protocol handover of the roads for maintenance to 31.08.2031, for Part 3 from 01.05.2027 to 30.04.2031, and if the contract is signed after 01.05.2027, it will be valid from the date of the protocol handover of the roads for maintenance to 30.04.2031, for Part 4 from 01.06.2027 to 31.05.2031, and if the contract is signed after 01.05.2027, it will be valid from the date of the protocol handover of the roads for maintenance to 31.05.2031, with the proviso that for all Parts of the contract the maximum total period of validity of the Contract, including the option right, referred to in § 1(8), may not exceed 48 months from the start of the contract performance, works of year-round, including winter and current maintenance of roads, in particular: - maintenance of road surfaces and engineering structures - maintenance of verges and dividing strips - maintenance of the road body - maintenance of drainage - maintenance of pavements and cycle paths - maintenance of signage - maintenance of traffic safety devices - maintenance of the aesthetics of signs, traffic safety elements and the roadway - maintenance of auxiliary devices - winter maintenance of roads - Contract Management - maintenance of cleanliness and repair and maintenance work on engineering structures. The detailed scope of the contract subject required to be performed is specified in the Contract Subject Description, Technical Specifications, Draft Contract Clauses. The Contracting Authority envisages the possibility of applying the option right referred to in Article 441(1) of the Pzp Act. Within the framework of this contract, the Contracting Authority envisages the possibility of applying the option right in the scope of: 1) Performance of works on road sections other than those indicated in §1(1), located in the District, the roads of which are maintained within the framework of this Contract, or in the adjacent Districts to it, entering the structure of GDDKiA, specified in Annex No. 15 to the Contract in the scope specified in Annex No. 2 to the Contract Tables of Settlement Elements for works marked as works to be implemented within the scope of the option right. These works will be settled at the prices specified by the Contractor for the basic contract for these works. The prices for roads of the same cross-section and maintenance standard will be used to calculate the Contractor's remuneration; 2) the possibility of entrusting the Contractor with the performance of works, in the event referred to in § 3(2) - for a period not longer than 10 months - within the scope of the basic contract, at the prices specified by the Contractor for the basic contract in Annex No. 2 to the Contract Tables of Settlement Elements, Collective Summary of Costs, with the proviso that the maximum total period of validity of the Contract, including the option right, may not exceed 48 months. Further information on the option is contained in the subsequent Volumes of SWZ. The value of the contract is above 140 000 EUR. The Contracting Authority reserves the obligation of personal performance by the Contractor of the key tasks covered by the subject of the contract. The Contractor is obliged to personally perform the key tasks reserved by the Contracting Authority, in accordance with Article 121 of the Pzp Act, specified in Group of Works No. 11 – Contract Management, i.e. activities performed by the following members of the Road Maintenance Team: - Road Maintenance Manager; - Deputy Road Maintenance Manager. With regard to the key task reserved for personal performance by the Contractor, the Contractor may not rely on the capabilities of the entity providing resources, on the basis of Article 118(1) of the Pzp Act, in order to demonstrate compliance with the relevant conditions for participation in the procedure.
