Description

The subject of the contract is the improvement of vocational training quality in the City of Suwałki through the reconstruction, expansion, and change of use of an educational building with 2 residential units to an educational building in Zespół Szkół nr 4 at ul. Sejneńska 14 in Suwałki (due to the limitations of the contract notice, the full text is in the SWZ) 2. The detailed description of the subject of the contract includes: technical documentation, technical specifications for the execution and acceptance of works, work items constituting the annexes to the SWZ. 3. All works must be carried out in accordance with the technical documentation and applicable technical conditions and regulations. 4. In accordance with Article 101(4) of the Act, in the place where the subject of the contract is described using standards, technical assessments, technical specifications, and technical reference systems, the Purchaser allows solutions equivalent to those described. Furthermore, it should be assumed that all such references are accompanied by the words "or equivalent". The indication of the equivalence of the offered solution in accordance with Article 101(5) of the Act and on the principles specified therein rests with the Contractor, in which case the Contractor is obliged to prove, by attaching to the offer the appropriate substantive evidence referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 5. In the event that trademarks have been used in the design documentation or technical specifications for the execution and acceptance of works, this means that they are given as examples and only define the minimum expected quality parameters and the required standard. The Contractor may use equivalent materials or equipment, but with technical and quality parameters similar to or better than those, the use of which in no way negatively affects the proper functioning of the solutions adopted in the design documentation. The Contractor who uses equivalent equipment or materials will be obliged to demonstrate during the execution of the contract that the materials and equipment used by him meet the requirements specified by the Purchaser. 6. The use in the design documentation of the label indicates that the Purchaser accepts all labels confirming that the given construction works, supplies, or services meet the equivalent requirements specified by the Purchaser. In the event that the Contractor, for reasons beyond his control, cannot obtain the label specified by the Purchaser or an equivalent label, the Purchaser within the time limit set by him accepts other appropriate substantive evidence, in particular the producer's documentation, provided that the given Contractor proves that the construction works, supplies, or services, which are to be carried out by him, meet the requirements of the specified label or the requirements specified by the Purchaser. 7. The use in the design documentation of the requirement to have a certificate issued by a conformity assessment body or a report on tests carried out by this body as evidence confirming compliance with the requirements or features specified in the description of the subject of the contract, evaluation criteria for offers, or contract execution conditions means that the Purchaser also accepts certificates issued by other equivalent conformity assessment bodies. The Purchaser also accepts other appropriate evidence, in particular the producer's technical documentation, in the event that a given Contractor does not have access to certificates or test reports, or the possibility of obtaining them within the appropriate time limit, provided that this lack of access cannot be attributed to the given Contractor, and provided that the given Contractor proves that the construction works, supplies, or services carried out by him meet the requirements or criteria specified in the description of the subject of the contract, evaluation criteria for offers, or requirements related to the execution of the contract. 8. If the description of the subject of the contract includes a provision resulting from the KNR or KNNR indicating the need to use specific equipment with specific parameters in the execution of the contract, the Purchaser allows the use of other equipment provided that it ensures the achievement of the designed project parameters and does not pose a risk of non-compliance of the completed works with the technical documentation. 9. In the case of a description using standards, equivalent solutions are considered to be those that ensure compliance with the minimum requirements specified in the standard at a level not worse than described in the relevant standards. In the case of standards referred to in the SWZ (if not specified in detail), current standards are understood. In other cases (description of the subject of the contract using technical assessments, technical specifications, and technical reference systems), an equivalent product, material, or system is considered to be one with technical, functional, and quality parameters not worse than those mentioned in the description of the subject of the contract. 10. The project is co-financed under the programme Fundusze Europejskie dla Podlaskiego 2021-2027. 11. The Contractor's obligations include the execution and installation of 1 information board, which must be executed in accordance with the Guide for applicants and beneficiaries of the European Funds for 2021-2027 in the scope of information and promotion. The project and content of the board as well as the place of installation the Contractor is obliged to agree with the Purchaser. CHANGES to the contract are specified in attachment no. 3 to the SWZ (due to the limitations of the contract notice, the full text is in the annex to the SWZ) The Purchaser informs that, in accordance with Article 139 of the Act, it may first carry out an examination and evaluation of offers, and then carry out a subjective qualification of the Contractor, whose offer was the highest, in the scope of the absence of grounds for exclusion and the fulfillment of the conditions for participation in the procedure.
