Description

The subject of the contract is the execution of ancillary infrastructure for the construction of the Nuclear Power Plant EJ1 in the form of an MOLF (Marine Off-Loading Facility – marine unloading facility) together with the execution of dredging works for the future manoeuvring basin and turning basin. The detailed specification of the subject of the contract is contained in Annex No. 1 to the Description of Needs and Requirements. 2. The subject of the contract also includes preparatory works in the scope of: tree felling, securing of dunes and Natura 2000 areas, preparation of technological and access roads to the construction site, preparation of the construction site and organisation of the social and office infrastructure of the construction, as well as the removal of ferromagnetic objects. The contractor will independently prepare all the documents necessary for the execution of the works covered by the Investment and will make the appropriate agreements and obtain, on behalf of the Contracting Authority, all the consents and administrative decisions necessary for the implementation of the Task, resulting from the provisions of the Act of 29 June 2011 on the preparation and implementation of investments in the field of nuclear energy and related investments, hereinafter referred to as the "Specustawa" or from the project documentation provided by the Contracting Authority. 3. The Contracting Authority does not divide the contract into parts and thereby does not allow the possibility of submitting partial offers in the sense of art. 7 point 15 of the Pzp Act. The Contracting Authority has waived the division of the subject of the contract into parts due to its indivisible, homogeneous character. The construction of the First Nuclear Power Plant (EJ1) is a strategic investment from the point of view of the security interest of the State, and the subject of the contract has a critical significance for the possibility of its construction - constituting the only route for deliveries to the construction site for oversized components of the power plant, which must be transported in whole and exclusively by sea. The lack of division of the contract into parts significantly reduces the implementation risks resulting from the coordination of works and control of several contractors, having a direct impact on the implementation deadline of the investment. The division of the subject of the contract into parts would also contribute to the lack of a subject responsible for the entire contract and would significantly hinder the enforcement of claims arising from the non-performance or improper performance of the contract by the contractor, within the framework of securing the proper performance of the contract. 4. The Contracting Authority does not reserve the obligation of personal performance of key tasks by the Contractor.
