Poland – Fuels – Dostawa oleju napędowego, oleju opałowego lekkiego oraz benzyny do magazynu Miejskiego Zakładu Komunikacji w Starogardzie Gdańskim

The subject of the contract is the delivery to the Purchaser's warehouse (except for part III), i.e. Miejskie Zakład Komunikacji in Starogard Gdański, ul. Tczewska 20, 83-200 Starogard Gdański: 1) Part I - 540m³ of diesel fuel meeting the requirements of standard PN-EN 590 by volume at reference temperature 15°C. During the winter period, winter diesel fuel (standard diesel fuel, for which the cold filter plugging point during the winter period lasting from 16 November to the end of February should be max. -20°C according to standard PN-EN 590 and the Regulation of the Minister of Climate and Environment of 26 June 2024 on quality requirements for liquid fuels (Journal of Laws of 2024, item 1018 as amended)) must be delivered; 2) Part II - 10 m³ of light heating oil meeting the requirements of standard PN-C 96024:2011; 3) Part III - cashless purchase (cashless transactions using fuel cards are allowed) of unleaded petrol meeting the requirements of standard PN-EN 228, made directly at the Contractor's sales point (fuel station) located in the city of Starogard Gdański (operating at least from Monday to Saturday from 06:00 to 16:00) in the amount of 8 m³. Refueling will take place successively into the Purchaser's cans on the Contractor's fuel station premises. 2. The size of monthly deliveries and the cycle of partial deliveries, the deadline and type of fuel (depending on weather conditions, in the event of forecasted temperature drops below -20°C, the Purchaser will require delivery of fuel with enhanced parameters, so-called "arctic", for which the cold filter plugging point during the winter period is -32°C, according to standard PN-EN 590 and the Regulation of the Minister of Climate and Environment of 26 June 2024 on quality requirements for liquid fuels (Journal of Laws of 2024, item 1018 as amended)) will be specified by the Purchaser by e-mail, no later than 48 hours before the delivery deadline to the Purchaser's warehouse: 1) diesel fuel in the amount of 18-21m³; 2) light heating oil in the amount of 1m³. 3. The above quantities of diesel fuel and light heating oil may change depending on the Purchaser's needs within ± 20% of the specified quantity. 4. With each fuel delivery, a certified fuel quality certificate must be delivered for proof of issue designated with a number from the given producer or made by an authorized laboratory (or its copy, which may be generated in the form of an electronic printout containing the name and surname of the authorized person). In addition, the certificate must: 1) be consistent with the fuel qualification; 2) contain basic data characterizing the delivered fuel; 3) be dated and have a control number of the test performed; 4) be made no earlier than 7 days before delivery; 5) be written in Polish or translated into Polish. 5. In the case of cashless purchase of petrol, the Purchaser will waive the requirement to submit a quality certificate. 6. With each partial delivery (applies to Part I and II), a fuel sample may be taken from the tanker for laboratory analysis in an accredited laboratory (applies to any complaint). The taken sample must be in two identical, marked and sealed containers, one for the Contractor and one for the Purchaser. The Contractor will supply the sample containers. 7. In the event of circumstances indicating that the fuel quality does not meet standard PN-EN 228, (applies to retail purchases - Part III), the Purchaser will lodge an appropriate complaint in accordance with the Contractor's procedure.
