The subject of the contract is: The provision of the service of collecting and managing municipal waste from the owners of residential properties located in the City of Pszów in 2027. 2. The scope of the contract includes: 1) Collection of municipal waste from all residential properties located in the City of Pszów, from the municipal market and from the collection point of waste from emptied street bins. Loading and collection of waste will take place between 7:00 - 20:00; 2) Management of all municipal waste collected from the City of Pszów in a manner consistent with the applicable legal provisions, enabling the achievement of the required statutory recycling levels, not exceeding the levels of waste disposal and maintaining the levels of limiting the mass of biodegradable municipal waste disposed of; 3) Equipping all residential multi-family buildings and municipal points with containers (bins) for mixed waste, containers (bins) for bio-waste and containers (bins) for selective collection, which are the property of the Contractor; 4) Equipping all single-family residential buildings with containers (bins) for mixed waste, containers (bins) for bio-waste, containers (bins) for ashes and furnace clinkers, and bags for selective waste collection, along with their distribution (for each bag of selectively collected waste handed over by the property owner, an empty bag of the same type should be left). 3. Area of the City of Pszów: 20.42km2; 4. Population: 11,114; 5. Number of single-family buildings: 2,332; 6. Number of multi-family buildings: 102; 7. Estimated amount of waste in 2027: 4,573Mg/year; 8. A detailed description of the subject of the contract is the Specification of Contract Terms along with the annexes, including in particular Annex No. 12 to SWZ entitled “Detailed Description of the Contract” and Annex No. 11 entitled “Projected Contractual Provisions”. 9. The contracting authority in this procedure does not divide the contract into parts, nor does it allow the submission of partial offers. 10. The contracting authority does not require the implementation of the contract by sheltered workshops, social cooperatives, or other contractors covered by the provisions of Article 94(1) of the Act. 11. The contracting authority, pursuant to Article 95(1) of the Public Procurement Act, requires the Contractor or Subcontractor to employ, under an employment contract in accordance with the provisions of the Labour Code of 26 June 1974 (i.e. Journal of Laws of 2025, item 277 as amended), persons performing the activities indicated below during the implementation of the contract, including work directly related to waste collection, namely: a) drivers of waste collection vehicles, and b) persons involved in waste collection. Other regulations in this regard are set out in §4 “Projected Contract Terms”. 12. The contracting authority does not envisage awarding contracts involving the repetition of similar services, as referred to in Article 214(1)(7) of the Public Procurement Act. 13. The contracting authority does not allow the submission of variant offers. 14. The contracting authority does not envisage conducting an electronic auction. 15. The contracting authority did not conduct preliminary market consultations before initiating the procedure. 16. The contracting authority does not require contractors to submit substantive evidence in this procedure. 17. The contracting authority, within the limits set by Article 462 and subsequent provisions of the Act, allows the possibility of implementing the subject of the contract by the Contractor using subcontractors. A contractor who intends to entrust the execution of part of the contract to subcontractors shall indicate in the offer the parts of the contract which they intend to entrust to subcontractors, and shall provide the names of any potential subcontractors, if known. NOTE to point 5.1.12 - The deadline by which the offer must be valid - Due to the requirements of the announcement format, the contracting authority has entered a 73-day period for the binding of offers, which corresponds to the period for the binding of offers until 31.12.2026.
