4.1 The subject of the contract is the winter maintenance of roads, parking lots and pavements in the area of the Gmina Andrychów in 2027, within the scope of tasks: 4.1.1 Task No. 1 – town of Andrychów 4.1.2 Task No. 2 – Sołectwo Rzyki 4.1.3 Task No. 3 – Sołectwo Targanice 4.1.4 Task No. 4 – Sołectwo Brzezinka 4.1.5 Task No. 5 – Sołectwo Roczyny 4.1.6 Task No. 6 – Sołectwo Sułkowice Łęg 4.1.7 Task No. 7 – Sołectwo Zagórnik 4.1.8 Task No. 8 – Sołectwo Inwałd 4.1.9 Task No. 9 – Sołectwo Sułkowice Bolęcina 4.2 Winter maintenance of roads includes in particular: 4.2.1 Clearing snow and preventing road slipperiness; 4.2.2 Clearing snow and preventing slipperiness of pavements, parking lots and parking spaces. 4.3 The detailed description of the subject of the contract is contained in Annex No. 10 to SWZ together with Annexes: 10.1 Winter road maintenance standards, 10.2 Technical specification, 10.3 List of road, pavement and parking sections. 4.4 The contractor is obliged to implement the contract on the principles and conditions described in the contract project constituting Annex No. 6 to SWZ. 4.5 The contracting authority divides the contract into 9 parts: 4.5.1 Part 1: Task No. 1 – town of Andrychów 4.5.2 Part 2: Task No. 2 – Sołectwo Rzyki 4.5.3 Part 3: Task No. 3 – Sołectwo Targanice 4.5.4 Part 4: Task No. 4 – Sołectwo Brzezinka 4.5.5 Part 5: Task No. 5 – Sołectwo Roczyny 4.5.6 Part 6: Task No. 6 – Sołectwo Sułkowice Łęg 4.5.7 Part 7: Task No. 7 – Sołectwo Zagórnik 4.5.8 Part 8: Task No. 8 – Sołectwo Inwałd 4.5.9 Part 9: Task No. 9 – Sołectwo Sułkowice Bolęcina 4.6 The contracting authority, pursuant to Article 95(1) of the Pzp Act, requires the contractor or subcontractor to employ, on the basis of an employment contract, persons performing the activities indicated by the contracting authority within the scope of the contract implementation, if the performance of these activities involves performing work in the manner specified in Article 22(1) of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277, as amended), i.e.: work related to snow removal and combating winter slipperiness. 4.7 The contractor is obliged to submit to the contracting authority, upon each request, within the deadline specified in the request, the following evidence confirming the fulfilment of the employment requirement on the basis of an employment contract by the contractor or subcontractor of persons performing the activities specified in point 4.6 SWZ during the contract implementation: 4.7.1 a statement by the contractor or subcontractor of employment on the basis of an employment contract of persons performing the activities covered by the contracting authority's request. This statement should include, in particular: a precise indication of the entity submitting the statement, the date of submission of the statement, an indication that the activities covered by the request are performed by persons employed on the basis of an employment contract, with an indication of the number of such persons, the first and last names of these persons, the type of employment contract and the scope of employment, as well as the signature of the person authorised to submit the statement on behalf of the contractor or subcontractor, 4.7.2 statements of employed workers containing information, including personal data, necessary to verify employment on the basis of an employment contract, in particular the first and last name of the employed worker, the date of conclusion of the employment contract, the type of employment contract and the scope of the worker's obligations, 4.7.3 a copy of the employment contract/employment contracts of persons performing activities during the implementation of the contract, which is the subject of the aforementioned statement by the contractor or subcontractor (together with the document regulating the scope of obligations, if prepared). The copy of the contract/employment contracts should be anonymised in a manner ensuring the protection of the personal data of workers, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (in particular, without addresses, workers' PESEL numbers). The worker's first and last name does not require anonymisation. Information such as: the date of conclusion of the contract, the type of employment contract, the scope of obligations and the scope of employment must be identifiable, 4.7.4 a certificate from the competent ZUS branch, confirming the payment by the contractor or subcontractor of contributions to social and health insurance on the basis of employment contracts for the last settlement period, 4.7.5 a copy of the document confirming the registration of the worker by the employer for insurance, certified as consistent with the original, respectively, by the contractor or subcontractor, anonymised in a manner ensuring the protection of the personal data of workers, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. The estimated total contract value for the contract qualifies the procedure for a contract estimated at a total value of over 216,000 EURO for services. The contracting authority allows for the submission of partial offers. Offers can be submitted in relation to all parts. The contractor may submit an offer for any number of parts of the contract, for one selected or all parts of the contract, however, the contractor may submit only one offer for a given part of the contract.
