Poland – Sewage, refuse, cleaning and environmental services – Odbieranie i zagospodarowanie odpadów komunalnych z terenu Gminy Skrwilno w 2027 r.

The subject of the contract is the provision of services in the area of the Municipality of Skrwilno from 01.01.2027 to 31.12.2027, including the collection, transport, and disposal of municipal waste from owners of residential and non-residential properties where municipal waste is generated, as well as from properties with holiday homes and other properties used for recreational purposes within the Municipality of Skrwilno. 2. The contractor will be obligated to collect and dispose of waste accumulated at the Selective Municipal Waste Collection Point located at 43 Kościelna Street, Skrwilno. 3. The procurement procedure is conducted as an unrestricted tender in accordance with Article 132 of the Act of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2026, item 793 with later amendments). 4. The contracting authority intends to apply the so-called reverse procedure, as mentioned in Article 139 (excluding paragraph 2) of the Public Procurement Law, i.e. the contracting authority will first conduct an examination and evaluation of offers, and then qualify the contractor whose offer was highest rated, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 5. The contracting authority requires the contractor or subcontractor to employ, under an employment contract, persons performing activities within the scope of the contract subject matter, i.e. activities related to the collection and disposal of waste, if they fall within the scope of Article 22 § 1 of the Labour Code. 6. Contractors who meet the criteria related to: 1) the right to conduct a specified economic or professional activity, if it follows from separate provisions - the contracting authority specifies that the condition will be met if the contractor demonstrates that it has: a) a current entry in the register of regulated activities in the field of collecting municipal waste from owners in the Municipality of Skrwilno, in accordance with the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2025, item 733 with later amendments); b) a current entry in the BDO register kept by the competent Marshal of the Voivodeship, pursuant to Article 49(1) of the Act of 14 December 2012 on Waste (Journal of Laws of 2026, item 1328 with amendments) - the contracting authority requires the aforementioned subject evidence. The assessment of whether the above condition required from contractors is met will be made on the basis of the submitted documents. 2) economic or financial situation - the contractor should have civil liability insurance for the conducted activity related to the subject of the contract in an amount not less than 200,000.00 PLN (two hundred thousand) - the contracting authority requires the aforementioned subject evidence. 3) technical or professional capacity a) The contractor must demonstrate the implementation of at least 1 service in the field of collecting municipal waste, in the last three years before the deadline for submitting offers, and if the period of conducting the activity is shorter - in this period. Details - the requirement relates to 1 service of collecting municipal waste performed for the owners of properties from one municipality in a continuous manner for a minimum period of 12 months with a total waste mass of at least 900 Mg for one contract - the contracting authority requires the aforementioned subject evidence. b) the contractor must demonstrate the possession of specialist equipment in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements in the field of collecting municipal waste from owners of properties (Journal of Laws of 2013, item 122) including: - a vehicle of the "hooklift" type adapted to collect at least containers of the KP5, KP7 type - a vehicle with a HDS crane adapted to collect waste from selective collection from bell-type containers - a small garbage truck adapted to collect waste from properties with difficult access, equipped with a loading mechanism for loading containers with a capacity of 110 – 1100 litres - at least 2 vehicles adapted to collect mixed municipal waste with a compacting function, - 2 vehicles adapted to collect selectively collected municipal waste with a compacting function, - 1 vehicle for collecting waste without a compacting function. - the contracting authority requires the aforementioned subject evidence. 7. Mandatory grounds for exclusion of the contractor are specified in Article 108(1)(1-6) of the Public Procurement Law. 2. The contracting authority intends to exclude the contractor on the basis of Article 109(1)(4) of the Public Procurement Law: 1) in respect of which liquidation has been opened, bankruptcy has been declared, whose assets are managed by a liquidator or a court, has concluded an agreement with creditors, whose business activity is suspended or is in a similar situation resulting from a similar procedure provided for in the provisions of the place of initiation of this procedure. 3. Additionally, the contracting authority will exclude the contractor from the public procurement procedure, in respect of whom any of the circumstances referred to in: 1) Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 229 of 31.7.2014, p. 1, hereinafter: "Regulation 833/2014"), as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 111 of 8.4.2022, p. 1, hereinafter: "Regulation 2022/576"), 2) Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting the support for aggression on Ukraine and serving the protection of national security (Journal of Laws of 2024, item 507). 4. The exclusion of the contractor takes place in accordance with Article 111 of the Public Procurement Law.
