The subject of the contract is the collection and disposal of municipal waste from the area of the municipality of Zbąszynek. The scope of the contract concerns residential properties, i.e. properties used for residential purposes, as well as residential and commercial properties or commercial and residential properties in the residential part, and properties on which holiday homes or other properties used for recreational purposes are located. The subject of the contract has not been divided into parts. The contracting authority does not allow partial offers to be submitted. The subject of the contract is the collection and disposal of municipal waste. Only the performance of the entire service will allow the assessment of the correctness of the services performed. The division of the contract, in view of the constant successive scope of the entire contract, will result in the need for the contracting authority to coordinate the services of several contractors and may pose a risk of uncoordinated actions of the contractors. In the opinion of the contracting authority, the subject of the contract justifies the award of the contract to one contractor, who will assume responsibility for the risk of service performance, and the division of the contract into parts could transfer this risk to the contracting authority and, as a consequence, make it impossible to achieve the objective of the public procurement. The performance of one service by several contractors also constitutes a difficulty in exercising the rights arising from the guarantee and quality warranty. In summary, in the present procedure, the division of the contract into parts would not bring any benefits to the contracting authority or the contractors, and, given the scope and value of the contract, it would not lead to the opening of a competitive procedure.
