1. The subject of the contract is the purchase of thermal energy, including the distribution and purchase of thermal energy for educational facilities in the Ursynów district of Warsaw in 2027. 2. The location of the heat nodes, their tariff group, planned thermal energy consumption and ordered thermal power are indicated in the Price Form, which is Annex 2 to the SWZ. 3. The total planned thermal energy consumption is 68 034.00 GJ. 4. The contracting authority has made every effort to properly estimate the planned thermal energy consumption indicated in point 3. Due to unforeseeable external factors, such as weather conditions, particularly air temperature, which affect the actual demand for thermal energy, it is not possible to accurately indicate future thermal energy consumption. The actual thermal energy consumption will depend solely on the real needs of the educational facilities in the Ursynów district of Warsaw. The contractor may not claim any financial compensation from the contracting authority due to the purchase of a different quantity of thermal energy than indicated in point 3 or in the Price Form, which is Annex 2 to the SWZ. At the same time, the contracting authority specifies the minimum amount of thermal energy consumption at 34 017.00 GJ. 5. The contracting authority requires that the contract be executed on the principles and conditions described in the Draft Contract Terms, which is Annex 6 to the SWZ.
