The subject of the contract is the construction of flood protection for the town of Jastarnia from the Puck Bay side – section km 49.20-52.80 in the "design and build" system in accordance with the functional-user programme for 2 sections: the eastern and port section km approx. 49.20-51.40 and the middle section km approx. 51.40-52.80 as part of the project entitled: “Protection of the coast from flooding from the waters of the Gdańsk Bay” for the sections: 1). eastern and port km approx. 49.20-51.40, 2). middle km approx. 51.40 – 52.80 3). western km approx. 52.80-53.90. 2. The subject of the contract has been divided into two parts: Part 1 - Construction of flood protection for the town of Jastarnia from the Puck Bay side – Eastern and port section km approx. 49.20 - 51.40 in the "design and build" formula, Part 2 - Construction of flood protection for the town of Jastarnia from the Puck Bay side – Middle section km approx. 51.40 – 52.80 in the "design and build" formula. 3. The Contracting Authority allows the submission of partial offers for the individual separated parts. Offers can be submitted for all parts. 4. The detailed scope of the contract is included in the Functional-User Programme (Annex No. 4 to SWZ) 5. The implementation conditions have been defined in the Contract Project for Part 1 (Annex No. 5A to SWZ) and the Contract Project for Part 2 (Annex No. 5B to SWZ). 6. The contract is co-financed from the funds of the European Union within the Programme European Funds for Infrastructure, Climate, Environment for the years 2021-2027 (FEnIKS) for the years 2021-2027 - “Protection of the coast from flooding from the waters of the Gdańsk Bay. 7. In accordance with art. 95 para. 1 and para. 2 of the Pzp Act, the Contracting Authority requires that during the implementation of the contract, the Contractor or the Subcontractor designated by him permanently employs, on the basis of an employment contract, in a scope of work adequate to the tasks entrusted, persons performing the activities specified in §2 para. 29 of the Agreement. The detailed manner of verifying the employment of persons, as referred to in para. 1), has been defined in §2 para. 32 of the Agreement. The rights of the Contracting Authority in the scope of controlling the fulfillment by the contractor of the requirements related to the employment of persons have been defined in §2 para. 33-36 of the Agreement. Sanctions for failure to meet the requirements related to the employment of persons have been defined in §22 para. 1 point 9) of the Agreement. 8. Contract completion deadline for Part 1 and 2: within 24 months from the date of signing the contract.
