Poland – Natural gas – „Kompleksowa dostawa gazu ziemnego obejmująca sprzedaż i dystrybucję gazu na potrzeby Gminnego Ośrodka Kultury Perła w Nowinach” – II postępowanie

The subject of the contract is the comprehensive supply of high-methane natural gas in accordance with the Act of 10 April 1997 — Energy Law (i.e. Journal of Laws of 2026, item 43 with later amendments), including the sale and distribution of gas with a forecast volume of approximately 3,200,000 kWh, calculated over the delivery period, to the buildings of the Municipal Cultural Centre Perła in Nowiny, ul. Perłowa 1, 26-052 Nowiny, for own use, for heating purposes. 1) The Contractor is obliged to carry out all actions and agreements with the Distribution System Operator (Polska Spółka Gazownictwa Rejon Dystrybucji Gazu w Tarnowie), necessary to carry out the procedure for changing the supplier with the Distribution System Operator. The procedure for changing the supplier will be carried out once. 2) The Contractor is obliged to carry out, on behalf of the Purchaser, the procedure for changing the current supplier of natural gas. 3) Information on the current status of agreements for gas take-off points: • agreement concluded for a specified period until 30.09.2026 with the Contractor: „PGNiG Obrót Detaliczny Sp. z o.o. ul. Jana Kazimierza 3, 01-248 Warsaw. 4) The anticipated consumption of gaseous fuel is of an estimated nature and serves solely for the comparison of offers and in no way constitutes a commitment by the Purchaser to purchase the specified quantity of natural gas. The Contractor will not be entitled to any claim arising from the Purchaser's failure to take the specified quantity of gas, or from taking a larger quantity of gas than forecast. 5) The Purchaser is not covered by tariff protection under the Act of 26.01.2022 on special solutions serving to protect recipients of gaseous fuels in connection with the situation on the gas market. 6) The Purchaser conditions the commencement of the service on the effective conduct of the supplier change process with the Distribution System Operator. 7) The Purchaser will not control the value of the contract. The indicated consumption of natural gas over a 12-month period is merely indicative, serving to compare offers and in no way constitutes a commitment by the Purchaser to purchase the specified quantity of natural gas. In the event of excess, the Purchaser will pay for the actual consumption of gaseous fuel. 8) The Purchaser consents to receiving advance invoices in the W-6.1 tariff group based on the forecast consumption of gaseous fuel and a settlement invoice for the gaseous fuel taken, issued at the end of the settlement period, the amount of which will be reduced by the amount resulting from the advance invoices. 2.
