The subject of the contract is the successive delivery of vegetables and fruits in 2027 – including unloading in the warehouses of the 32 Economic Unit located in military complexes in the area of operation of the 32 Economic Unit in Zamość: Zamość, Lublin, Chełm, Hrubieszów in the scope of 4 (four) parts:

DETAILED DESCRIPTION OF THE SUBJECT OF THE CONTRACT

The detailed description of the subject of the contract in the scope of part no. 1, part no. 2, part no. 3, part no. 4, are specified by:

1) Minimum quality requirements in the scope of part no. 1 – constituting Annex no. 1a to SWZ;

2) Minimum quality requirements in the scope of part no. 2 – constituting Annex no. 1b to SWZ;

3) Minimum quality requirements in the scope of part no. 3 – constituting Annex no. 1c to SWZ;

4) Minimum quality requirements in the scope of part no. 4 – constituting Annex no. 1d to SWZ;

DETAILED REQUIREMENTS OF THE CONTRACTING AUTHORITY REGARDING THE DELIVERY

1. The Contracting Authority reserves the right to use the option right (option right - 100% of the basic order) within the framework of the Contract, not exceeding the assortment and quantity contained in the annex, to the contract column “SCOPE OF THE OPTION RIGHT”.

2. The final quantity of food purchased under the option right will depend on the current needs of the Contracting Authority and the financial resources available to it.

3. Food purchased under the option right must meet all the requirements as for the guaranteed order.

4. The Contracting Authority reserves that the part of the order specified as “option right” is an entitlement, and not an obligation of the Contracting Authority. The Contracting Authority may not use the option right, in particular in the event of not obtaining financial resources for this purpose, and no claims arise to the Contractor on this account which the Contractor accepts by signing this contract.

5. The Contracting Authority guarantees to place orders within the framework of the basic order for the delivery of goods at a level not lower than 30% of the gross value of the Contract, as referred to in § 4 para. 4 of the contract template constituting Annex no. 3 to SWZ. The implementation of the Contract in the remaining scope will depend on the actual needs of the recipients resulting from the variable number of entitled to food and financial resources allocated for this purpose.

6. No claims for damages are due to the Contractors for the failure to place and implement orders by the Contracting Authority at a level higher than 30% of the maximum gross value of the Contract of the basic order.

7. In the event of the Contracting Authority using the option right, the Contractors will be entitled to remuneration according to the unit prices as for the guaranteed order.

8. The total scope of the option right has been described in the contract template constituting Annex no. 3 to SWZ.

9. The assortment-quantity list for the individual warehouses of the 32 Economic Unit located in military complexes in the area of operation of the 32 Economic Unit in Zamość – delivery points has been presented in Annex no. 2 to SWZ.
