Poland – Electricity, heating, solar and nuclear energy – Zakup energii elektrycznej dla obiektów PWiK Sp. z o.o. na okres od 01.01.2027r. do 31.12.2027r.

1) The subject of the procurement is the purchase of electrical energy for the Contracting Authority's facilities and the buyback of excess electrical energy generated in the Contracting Authority's production sources located in the municipalities of Wodzisław Śląski, Radlin, Rydułtowy, Gorzyce, Marklowice, Gaszowice, Godów from 01.01.2027 to 31.12.2027 in an estimated quantity of 3324.434 MWh. 2) The estimated demand for electrical energy is specified in Annex No. 4 to the SWZ. The quantities presented in Annex No. 4 to the SWZ are estimated quantities, calculated based on the historical consumption to date, in order to determine the value of the procurement. The Contracting Authority guarantees that the minimum total amount of consumption will not be less than 60% of the volume indicated in Annex No. 4 to the SWZ. 3) The sale of energy will take place through the distribution network owned by the local Distribution System Operator (DSO). The Contracting Authority requires that the Contractor executing the procurement has, by the date of signing the sales agreement at the latest, a valid agreement with the DSO, based on which it is possible to conduct the sale of electrical energy through the distribution network of that DSO to all of the Contracting Authority's facilities indicated in Annex No. 4 to the SWZ. 4) Settlements for the supplied electrical energy will be made based on the readings of the metering and billing systems according to the unit prices for the given point of delivery based on the actual consumption of energy and will be increased by the value of the fixed component payable monthly, specified in the Contractor's price offer (commercial fee). 5) The Contracting Authority has the legal title to dispose of the facilities described in Annex No. 4 to the SWZ. 6) The Contracting Authority requires that the settlement period be consistent with the DSO's settlement period. 7) The Contracting Authority will conclude one sales agreement, covering all of the Contracting Authority's points of delivery. 8) The Contracting Authority allows for the conclusion of a comprehensive agreement for sale and distribution. 9) The Contracting Authority allows for the possibility of signing the agreement by correspondence or in electronic form (using an electronic signature). 10) The Contractor will conclude, on behalf of the Contracting Authority, an agreement for the provision of distribution services in the case of points of delivery for which comprehensive agreements previously applied and in the case of points of delivery for which the distribution agreement was concluded for a specified period. The Contracting Authority has provided the time necessary to conclude a distribution agreement for points of delivery of energy, for which the distribution agreement is not concluded for an indefinite period. 11) The Contracting Authority has not concluded any promotional agreements or annexes. 12) The purchased energy will be used exclusively for own needs. The Contracting Authority declares that it is a final recipient within the meaning of the provisions of the Act of 06.12.2008 on excise duty (Journal of Laws of 2026, item 412, as amended). 13) The Contracting Authority has the status of a producer, as referred to in Article 2(39) of the Act of 20 February 2015 on renewable energy sources (Journal of Laws of 2026, item 68, as amended). 14) The rules for the buyback of excess electrical energy are specified in Annex No. 2b – Tender Form – Buyback and Annex No. 3 – Contract Template. 15) The Contracting Authority envisages the possibility of reducing the number of points of delivery of electrical energy, as referred to in Annex No. 4 to the SWZ, while maintaining a 30-day notice period. 16) The Contractor is obliged to execute the procurement on the terms and conditions described in the contract template constituting Annex No. 3 to the SWZ.
