The competition is a design competition, i.e., one in which the Prize is a monetary prize and an invitation to the author (Participant) of the selected Competition Work to negotiate in the framework of a negotiated procedure without prior publication, for the performance of the service on the basis of the Competition Work. The subject of the service has been preliminarily described in the Essential Contract Terms constituting Annex 1 to the Rules. The aim of the Competition is to obtain the best concept of the Museum of the Szkuty and Urzecze building, together with the development of the area, in the scope indicated in Annex 6a as the scope of the competition design. The Competition is conducted in the procedure of a limited and single-stage competition, i.e.: – Entities interested in participating in the Competition submit applications for admission to the Competition in accordance with the provisions of Section IV of the Rules within the time limit specified in the Competition Schedule; – The Organizer admits to the Competition and invites to submit Competition Works Participants who meet the objective criteria specified by the Organizer in Section IV of the Rules. – Submission of Competition Works by Participants admitted to the Competition within the time limit specified in the Competition Schedule. The material scope, form of preparation and method of presentation of the Competition Works have been specified in Section V of the Rules; – Evaluation of the anonymized Competition Works by the Competition Jury on the basis of the criteria specified in Section VI of the Rules. – Resolution of the competition, i.e. selection of the best Competition Work (1st Prize) and awarding of the remaining Prizes in accordance with the provisions of Section VII of the Rules; – Approval by the Contracting Authority of the resolution of the competition and the official announcement of the results of the Competition; – The results of the resolution of the Competition becoming final. A competition participant must meet all of the following requirements: a) is not excluded on the basis of Article 108(1) and Article 109(1)(4)-(5), (6) and (7)-(10) of the Act (whereby the conflict of interest referred to in Article 109(1)(6) is assessed exclusively in relation to the Participants of the Competition in relation to the members of the Competition Jury and the reserve judges appointed in the Competition Rules); b) is not excluded on the basis of Article 7(1) of the Act of 13 April 2022 on specific solutions in the field of counteracting support for aggression against Ukraine and serving to protect national security, c) is not excluded on the basis of Article 5k of Regulation 833/2014 as amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of actions by Russia destabilising the situation in Ukraine. NOTE: The above requirements (lit. a), b), and c) apply to the Participant taking part in the competition independently and to each of the Participants taking part in the Competition jointly and to the entities on whose resources the Competition Participant relies. d) meets the condition of participation in the Competition specified by the Organizer regarding technical and professional capacity in terms of education and professional qualifications. This condition will be deemed to be met if the competition participant proves that it has, at the stage of the Competition, at least: – one person who will participate in the preparation of the competition concept and the Project Documentation, having building design authorisation in the field of architecture without restrictions, and having experience consisting in the preparation, in the period of the last 15 years before the deadline for submitting applications for admission to the Competition, (as author or member of the author's team) of at least one multi-disciplinary project documentation (covering the design project, execution projects and scope of works), on the basis of which a binding building permit was obtained, for the construction or reconstruction (excluding renovation) of a building of category IX with a net area of at least 2,000 m2 and performing author's supervision during the implementation of the investment on the basis of the multi-disciplinary project documentation referred to above until the building permit is obtained. e) meets the condition of participation in the Competition specified by the Organizer regarding technical and professional capacity in terms of experience. This condition will be deemed to be met if the competition participant proves that it: – has experience in the proper performance, within the last 15 years before the expiry of the deadline for submitting applications for admission to the competition, of at least one multi-disciplinary project documentation (covering the design project, execution projects and scope of works), on the basis of which a binding building permit was obtained, for the construction or reconstruction (excluding renovation) of a building of category IX with a net area of at least 2,000 m2 and performing author's supervision during the implementation of the investment on the basis of the multi-disciplinary project documentation referred to above until the building permit is obtained. NOTE In the case of the condition of participation in the competition specified above (i.e. Section 1(8) lit. e) of this Section), the competition participant may not rely on the resources of other entities. It must be the participant's own experience. f) The Organizer informs that a participant invited to negotiations will be obliged to prove that it will have, at the stage of performing the Subject of the service, persons capable of performing the order, about which persons it is mentioned in Section IX(1)(2) lit. c) of the Rules.
