The subject of the Contract is the management and supervision and control of the implementation of the Construction Contract during the design and Works phase within the project: „Increasing the capacity of the Tczew – Gdynia section: Pszczółki – Pruszcz Gdański”. The scope of the contract also includes: Property Option Right – involving the management and supervision of the design and implementation of construction works on: railway line no. 9 on the section from km 307.880 to km 315.420 and from km 317.510 to km 320.110 and railway line no. 226 from km 0.060 to km 0.260 and railway line no. 260 from km 3.494 to km 14.767; Term Option Right for the basic scope - involving the Entitlement of the Purchaser to extend the implementation period of the Basic Scope by a maximum of 12 months. Term Option Right for the Property Option Right - involving the entitlement of the Purchaser to extend the implementation period of the Property Option Scope by a maximum of 6 months. The Purchaser envisages awarding contracts, as referred to in Article 388 point 2) lit. c) of the Act. The scope of the contracts, as referred to in Article 388 point 2) lit. c) of the Act and the conditions on which they will be awarded are determined by OPZ. The Purchaser, in accordance with Article 257 of the Pzp Act, envisages the possibility of invalidating the procedure for awarding the contract, if the public funds that the Purchaser intended to allocate for the financing of the whole or part of the contract have not been granted to it. Similar contracts will be awarded in the procedure of a negotiated contract, after prior negotiations with the Contractor, in particular in the scope of the contract conditions, including the price, execution period, warranty period/guarantee period, on conditions analogous to those indicated in the basic contract and may include the performance of investor supervision over the preparation of design documentation and the execution of construction works carried out in the area covered by the subject investment, covering the following industry scope: track (surface, sub-ballast, subgrade, drainage); engineering and technical objects (such as road viaducts, railway viaducts, retaining walls, culverts, underpasses); traction and non-traction power engineering; road (bypass, access, parallel roads, loading yards, ramps etc.) serving traffic on railway premises; telecommunications; gas, heating, ventilation and sanitary networks; railway traffic control; cable, overhead and cable power networks, water-sanitary, c.o., gas, industrial networks, removal of all obstacles and collisions; passenger service facilities (platforms with equipment and access and access roads); volumetric objects (including signal boxes, buildings for SRK equipment etc.); acoustic screens; services in the field of geodesy; services in the field of cost estimation; services in the field of railway traffic engineering and transport organisation; services in the field of financial-economic; services in the field of environmental protection; other covered by the basic contract (especially in the scope of obtaining administrative decisions and performing author's supervision).
