The subject of the contract is the preparation of the design documentation for the reconstruction of the bridge over the Czarna Hańcza river, including access roads. The construction design for the bridge reconstruction, along with all the disciplines, must be prepared in accordance with the Construction Law and the Regulation of the Minister of Development of 11.09.2020 on the detailed scope and form of the construction design (Journal of Laws of 2022, item 1679, as amended). 2. A detailed description of the subject of the contract is contained in Annex No. 2 to the SWZ. 3. The Contractor is obliged to ensure that the subject of the contract is carried out by persons possessing the appropriate professional qualifications corresponding to the functions that will be entrusted to them. 4. Given that the documentation prepared by the Contractor will constitute a description of the subject of the contract, which is an annex to the SWZ for the implementation of construction works in accordance with the Act of 11 September 2019 on Public Procurement, the Contractor undertakes to prepare the documentation in such a way that it meets all the requirements of the Pzp. 5. The design documentation, in the scope of the description of the proposed materials and equipment, should be prepared in accordance with Article 99 of the Pzp. The subject of the contract may not be described in a manner that could hinder fair competition, in particular by indicating trademarks, patents or origin, source or a particular process that characterizes the products or services supplied by a specific contractor, if this could lead to the privileging or elimination of certain contractors or products. The technical documentation should take into account the provisions of Article 100 of the Pzp, i.e. "In the case of contracts intended for the use of natural persons, including the employees of the contracting entity, the subject of the contract is prepared, taking into account the requirements in the scope of accessibility for disabled persons and design for all users, unless this is justified by the nature of the subject of the contract. If the requirements referred to in paragraph 1 result from an act of European Union law, the subject of the contract, in the scope of requirements relating to accessibility for disabled persons and design for all users, is described by reference to that act". 7. In accordance with Article 101, paragraph 4 of the Act, where the subject of the contract is described using standards, technical assessments, technical specifications and technical reference systems, the Contracting Authority allows equivalent solutions to those described. Furthermore, it should be assumed that all such references are accompanied by the words "or equivalent". The indication of the equivalence of the offered solution in accordance with Article 101, paragraph 5 of the Act and on the principles set out therein, rests with the Contractor. 8. In the case of a description using standards, equivalent solutions are considered to be such solutions that ensure the fulfilment of the minimum requirements specified in the standard at a level not worse than described in the relevant standards. In the case of standards referred to in the SWZ (if this has not been specified in detail), current standards are understood. In other cases (description of the subject of the contract using technical assessments, technical specifications and technical reference systems), an equivalent product, material or system is considered to be one with technical, functional and quality parameters not worse than those mentioned in the description of the subject of the contract. CHANGES to the contract are specified in Annex No. 7 to the SWZ (due to the limitations of the contract notice, the full text is in the annex to the SWZ) The Contracting Authority informs that, in accordance with Article 139 of the Act, it may first carry out an examination and evaluation of offers, and then carry out a substantive qualification of the Contractor whose offer was most highly evaluated, in the scope of the absence of grounds for exclusion and compliance with the conditions of participation in the procedure.
