Description

The subject of the contract is the development of a variant concept for the repair, reconstruction of supporting structures and technical documentation for the repair/reconstruction of supporting structures located along Polna and Zahańcze streets in Suwałki. 2. A detailed description of the subject of the contract is contained in Annex No. 2 to the SWZ. 3. The Contractor is obligated to ensure that the subject of the contract is executed by persons possessing the appropriate professional qualifications for the functions that will be entrusted to them. 4. Given that the documentation prepared by the Contractor will constitute a description of the subject of the contract, which is an annex to the SWZ for the implementation of construction works in the procedure of the Act of 11 September 2019, the Law on Public Procurement, the Contractor undertakes to prepare the documentation in such a way that it meets all the requirements of the Public Procurement Law. 5. The design documentation in the scope of the description of the proposed materials and equipment should be prepared in accordance with Article 99 of the Public Procurement Law. The subject of the contract may not be described in a way that could hinder fair competition, in particular by indicating trademarks, patents or origin, source or a particular process that characterizes the products or services supplied by a specific contractor, if it could lead to the favouring or elimination of certain contractors or products. The technical documentation should take into account the provisions of Article 100 of the Public Procurement Law, i.e. "In the case of contracts intended for the use of natural persons, including employees of the contracting entity, the subject of the contract is drawn up, taking into account the requirements in the scope of accessibility for disabled persons and design for all users, unless this is not justified by the nature of the subject of the contract. If the requirements referred to in paragraph 1 result from an act of EU law, the subject of the contract, in the scope of requirements relating to accessibility for disabled persons and design for all users, is described by reference to that act". 7. In accordance with Article 101(4) of the Act, where the subject of the contract is described by means of standards, technical assessments, technical specifications and technical reference systems, the Contracting Authority allows solutions equivalent to those described. Furthermore, it should be assumed that all such references are accompanied by the words "or equivalent". The indication of the equivalence of the offered solution in accordance with Article 101(5) of the Act and on the basis specified therein rests with the Contractor. 8. In the case of a description by means of standards, equivalent solutions are considered to be those that ensure compliance with the minimum requirements specified in the standard at a level not worse than described in the relevant standards. In the case of standards referred to in the SWZ (if not specified in detail), current standards are understood. In other cases (description of the subject of the contract by means of technical assessments, technical specifications and technical reference systems), a product, material or system with technical, functional and quality parameters not worse than those mentioned in the description of the subject of the contract is considered equivalent. Changes to the contract are specified in Annex No. 7 to the SWZ (due to the limitations of the contract notice, the full text is in the annex to the SWZ) The Contracting Authority informs that, in accordance with Article 139 of the Act, it may first carry out an examination and evaluation of the offers, and then carry out a subjective qualification of the Contractor whose offer was the highest rated, in the scope of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. General information: 1) In the procedure for the award of a public contract, communication between the Contracting Authority and the contractors takes place using the e-Zamówienia Platform, which is available at https://ezamowienia.gov.pl. 2) The use of the e-Zamówienia Platform is free of charge. 3) The Contracting Authority designates the following persons for contact with the contractors: Anna Zackiewicz – procedural matters, tel.: 087 562 82 73, email: [email protected], [email protected], Janusz Zawadzki, Paweł Perkowski – substantive matters; Form of offer: 1) in accordance with Article 63(1) of the Public Procurement Law, in the procedure for the award of a contract, the offer is submitted, under pain of invalidity, in electronic form, i.e. signed with a qualified electronic signature; 2) the offer should be prepared in Polish, in electronic form – it is recommended to prepare the offer and declarations in PDF format and sign with a signature in PadES format.
