1. The subject of the contract is the support of the integrated IT system owned by the Contracting Authority. 2. The contract will be awarded in 2 parts: 1) Part 1 – Document circulation system and employee portal with elements: presentation of HR information, handling applications (including applications for absence, zfśs, training, performance appraisal, leave plan, training plan, authorizations), handling of own acts, handling of resource reservations. 2) Part 2 – HR and payroll system KSAT. 3. The conditions for the execution of the contract, along with a detailed description of the subject of the contract for each part, are contained in the draft contract clauses for the public contract, which will be introduced into the public contract agreement – template contract for the given part, which are respectively Annex 1C to SWZ for Part 1 and Annex 1D to SWZ for Part 2 (hereinafter referred to as the contract template(s)). 4. If in the description of the subject of the contract for Part 2 there are: trade names, patents or origin, source or special process, which characterizes the products or services provided by a specific contractor (in particular TeamViewer), this should be treated only as an aid in the description of the subject of the contract. In any case, equivalent products in terms of the software features specified in the contract are permissible. The Contracting Authority will assess the equivalence in terms of these features. In order to prove equivalence, the contractor is obliged to present, together with the offer or upon request of the Contracting Authority, the manufacturer's documentation, a product card, a technical specification or other documents confirming the fulfilment of all the required software features specified in the contract. The burden of proof of equivalence lies with the contractor. 5. The Contracting Authority specifies that in the case of Part 1 of the contract, the contractor will be obliged to transfer to the Contracting Authority the property rights to the works created, in accordance with the contract. 6. The Contracting Authority, pursuant to the provisions of Article 95 of the Act, specifies that in no part of the contract does it require the contractor or subcontractor to employ, under an employment relationship, persons performing activities within the scope of the contract. 7. The value of the contract is: 2 163 759,70 zł (excluding VAT) including Part 1: 1 764 453,40 zł, Part 2: 399 306,30 zł. 8. The contract in each part must be executed for a period of 12 months, counted from the date of commencement of the service, taking into account that: 1) for Part 1, the commencement of the service will take place no earlier than 4 November 2026 if the contract is concluded before that date, and in the case of a contract concluded after that date – on the date of conclusion of the contract, 2) for Part 2, the commencement of the service will take place no earlier than 1 December 2026 if the contract is concluded before that date, and in the case of a contract concluded after that date – on the date of conclusion of the contract.
