Execution of the complete project documentation and the execution of construction works based on it for the investment task entitled: "Reconstruction and Construction of the Athletics Stadium - athletics and football complex". The following contractors are excluded from the tender procedure: those in respect of whom any of the circumstances indicated in: 1) Article 108(1) and Article 109(1) points 7), 8) and 10) of the Pzp Act; 2) Article 7(1) of the Act of 13 April 2022 on specific solutions to counter the support of aggression against Ukraine and serving to protect national security. The exclusion of the Contractor shall apply for the duration of the circumstances specified in the above Article 7(1) and shall not be subject to exclusion from the procedure under Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 111 of 8.4.2022, p. 1), hereinafter: Regulation 2022/576. 3. Contractors who meet the conditions relating to: economic or financial situation: a) The Contracting Authority considers that the Contractor is in an economic or financial situation that ensures proper performance of the contract, if the contractor proves that it has financial resources or credit capacity of not less than 25,000,000.00 PLN (twenty-five million zlotys); In the case of a joint bid, the above condition may be met jointly by the Contractors, with the proviso that at least one of the Contractors jointly applying for the contract should have financial resources or credit capacity of not less than 15,000,000.00 PLN (fifteen million zlotys). technical or professional capacity: a) The Contractor shall meet the condition if it proves that it will have at least 1 person who will participate in the execution of the contract in the position of the lead architect, having valid architectural design authorisation without restrictions, who has prepared at least 2 project documentation for an athletics stadium agreed and approved by PZLA in the last 4 years. b) The Contractor shall meet the condition if it proves that it will have at least 1 person who will participate in the execution of the contract in the position of construction manager, having valid construction authorisation without restrictions to manage construction works in the construction and construction specialisation, who has at least 5 years of experience in performing independent technical functions in construction and has performed the function of construction manager in at least 2 athletics stadiums, football or athletics and football stadiums each with a value of at least 10,000,000.00 PLN. c) The Contractor shall meet the condition if it proves that it will have at least 1 person who will participate in the execution of the contract in the position of works manager, having valid construction authorisation without restrictions to manage construction works in the installation specialisation in the field of networks, installations and thermal, ventilation, gas, water and sewerage equipment, who has at least 6 years of experience in performing independent technical functions in construction and has performed the function of construction manager or works manager in at least 2 public utility buildings each with a usable area of at least 1,000 m2. d) The Contractor shall meet the condition if it proves that it will have at least 1 person who will participate in the execution of the contract in the position of works manager, having valid construction authorisation without restrictions to manage construction works in the installation specialisation in the field of electrical and power engineering equipment, who has at least 6 years of experience in performing independent technical functions in construction and has performed the function of construction manager or works manager in at least 2 athletics stadiums, football or athletics and football stadiums. e) The Contractor shall meet the condition if it proves that in the 10-year period prior to the deadline for submitting offers, or if the period of conducting business is shorter – in that period, it has properly executed at least 1 construction work consisting of the construction/ reconstruction or modernisation of a sports stadium, with a value of at least 13,000,000.00 PLN, on which an athletics track (min 4 lanes 800 m) was constructed and a PZLA certificate of at least category IV was obtained. f) The Contractor shall meet the condition if it proves that in the 10-year period prior to the deadline for submitting offers, or if the period of conducting business is shorter – in that period, it has properly executed at least 1 construction work consisting of the construction/ reconstruction or modernisation of a sports stadium meeting the necessary requirements to play at least in IV league according to the requirements set by the Polish Football Association (PZPN), with a value of at least 15,000,000.00 PLN gross. g) The Contractor shall meet the condition if it proves that in the 5-year period prior to the deadline for submitting offers, or if the period of conducting business is shorter – in that period, it has properly executed at least 2 construction works consisting of the construction/ reconstruction or modernisation of volumetric buildings with a value of at least 20,000,000.00 PLN gross each. It is permissible to meet each of the conditions described in points e) – g) separately (the experience of another entity may relate to all or selected conditions). It is not permissible to refer to part of the experience described in each of points e) – g) (summing up experience in the scope of one point).
