The subject of the contract is the execution of construction works along with the installation of facilities in the premises at 1 Kruka Street in Kwidzyn, related to the change of use of the premises for the needs of the permanent exhibition “Taki oto Kwidzyn”, implemented as part of the project “Comprehensive building and conservation works in the Castle in Kwidzyn along with the adaptation for exhibition purposes of the premises located in the neighboring new building” no. FENX.07.01-IP.04-0045/25 co-financed from the funds of the FEnIKS Programme and the state budget. 2. A detailed description of the subject of the contract is contained in: 1) the project documentation, which consists of: a) the construction project, i.e.: - architectural and construction project – PAB. Reconstruction of 6 service premises U1-U6. Change of use of part of the building/premises for the needs of the Permanent Exhibition – Taki oto Kwidzyn, by mgr inż. A. Downar, 2026, b) Technical Specifications for the Execution and Acceptance of Construction Works (referred to as “STWiORB”), 2) the project of the permanent exhibition “Taki oto Kwidzyn”, by Studio Karolina Fandrejewska, 18.07.2024 – exclusively selected parts of the project documentation in the scope of finishing works, finishing elements of the interior and devices included in the aforementioned subject for the building and installation part, made available by the Contracting Authority. Explanations to the made available documentation are included in the aforementioned detailed description OPZ, which is Annex 1 to the contract, 3) a quantitative-material list of lighting, 4) the subject of the works, which is Annex 1 to SWZ, 5) the draft contract for the aforementioned construction works, which is Annex 2 to SWZ, 6) a detailed description of the subject of the contract (hereinafter referred to as the detailed description OPZ), which is Annex 1 to the contract. 3. Equivalent solutions (if applicable): 1) in accordance with art. 101 para. 4 of the Public Procurement Law [hereinafter referred to as the PZP Act] in a situation where the description of the subject of the contract contains a reference to norms, European technical assessments, approvals, technical specifications and technical reference systems, as referred to in art. 101 para. 1 point 2 and para. 3 of the PZP Act, and such references are not accompanied by the expression “or equivalent”, it should be assumed that each: norm, European technical assessment, approval, technical specification, technical reference system appearing in the description of the subject of the contract is accompanied by the words “or equivalent”, 2) wherever in the description of the subject of the contract, in particular in the project documentation, technical specifications for the execution and acceptance of works, a trade name or trademark, patent or origin, source or particular process is used, which characterizes the product or service provided by a specific Contractor, if the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and understandable manner, such an indication is accompanied by the word “or equivalent”, 3) the indication of trade names in the project documentation or technical specifications for the execution and acceptance of works should be treated as exemplary names and is intended solely to specify the level of expectations of the Contracting Authority with respect to a specific product, material, device, or solution. The use of trade names of producers/products/materials/devices is for illustrative purposes only. 4. The Contracting Authority: 1) does not set requirements in the scope of employment of persons, as referred to in art. 96 para. 2 point 2 of the PZP Act, 2) does not reserve that only Contractors, as referred to in 94 of the PZP Act, may apply for the contract, 3) does not reserve the obligation of personal performance by the Contractor of key tasks, 4) does not envisage the award of contracts, as referred to in art. 214 para. 1 point 7 of the PZP Act, 5) does not envisage settlements in foreign currencies, 6) does not envisage the reimbursement of participation costs, including the reimbursement of costs incurred for the acquisition of a qualified electronic signature, 7) does not envisage the conclusion of a framework agreement, 8) does not envisage an electronic auction, 9) does not envisage the submission of electronic catalogues, 10) does not allow the possibility of submitting variant offers, 11) does not envisage the Contractor checking the documents necessary for the implementation of the contract, as referred to in art. 131 para. 2 point 2 of the PZP Act, 12) the Contracting Authority envisages the conduct of a site visit in accordance with art. 131 para. 2 point 1 of the PZP Act, 13) informs that the procedure is conducted in the Polish language. 5. The Contracting Authority informs that the requirements regarding subcontracting, joint application for a public contract, reliance on the resources of an entity making its resources available are contained in the provisions of SWZ, as well as partially in the draft contract, which is Annex 2 to SWZ. 6. The provisions of the Act of 5
