Description

The procurement of "Modernization of six study rooms in Building D through the supply of furniture and audio-video equipment, including the design and execution of related works", in accordance with the specifications in the terms of reference. Number of days within which requests for clarification can be submitted before the deadline for submission of tenders/applications: 20 days. The contracting authority will respond clearly and fully to all requests for clarification: on the 11th day before the deadline set in the invitation to tender for submission of tenders. Any request for clarification must be submitted in SEAP (https://www.e-licitatie.ro). The completion of the award procedure through the conclusion of the framework agreement is subject to the following suspensive condition, which will operate for a maximum period of 3 months from the deadline for submission of tenders. The conclusion of the framework agreement is conditional on the maintenance of funding sources from own revenues and/or the state budget, as the case may be. The signing of the framework agreement will only be possible to the extent that the legal provisions on the commitment of expenditures from budgets subject to public finance legislation, as well as the provisions of Government Decision No. 395/2016 for the approval of the Methodological Norms for the application of the provisions relating to the award of public procurement contracts/framework agreements from Law No. 98/2016 on public procurement, as amended, are respected. In the event that, for whatever reason, the funding sources are not secured or maintained during the period of application of the suspensive condition, the contracting authority will apply the provisions of Article 212(1) lit. c) point 2 of Law No. 98/2016, as amended, making it impossible to conclude the framework agreement. After the conclusion of the framework agreement, the subsequent contracts will be awarded according to the needs of the contracting authority and the availability of budget funds, with respect for the minimum and maximum quantities provided for in the award documentation and in the framework agreement. After the conclusion of the framework agreement, the subsequent contracts will be awarded according to the actual needs of the contracting authority and the availability of budget funds, with respect for the quantitative and financial limits set by the award documentation and by the framework agreement. The conclusion of the framework agreement does not, in itself, generate an obligation for the contracting authority to award subsequent contracts until the maximum estimated quantity or value is reached. Tenderers participating in the procedure understand and accept that the contracting authority and/or the Ministry of Education and Research cannot be considered responsible for any damages caused by the cancellation of the award procedure, under the law, or for the non-award of the subsequent related contracts, when this is determined by the lack of funds or by the reduction of the needs of the contracting authority. By submitting a tender, economic operators expressly accept the suspensive condition and assume the risks associated with participating in the procedure.
