Poland – Electricity, heating, solar and nuclear energy – Dostawa energii elektrycznej do obiektów na terenie gminy Wadowice w latach 2027-2028

1. The subject of the contract is the supply of electrical energy to facilities within the municipality of Wadowice, with a total estimated volume of 7,086,212 kWh during the supply period, i.e. from 01.01.2027 to 31.12.2028, separately for each metering system, but not earlier than after the effective termination of the current energy supply agreements and the positive completion of the supplier change procedure. 2. A detailed description of the subject of the contract, including a list of the facilities mentioned in paragraph 1 and the planned consumption of electrical energy, is contained in annexes 10.1-10.2, 11 and 12 to SWZ. 3. The sale of electrical energy will take place on the terms set out in the Act of 10 April 1997 on Energy Law (consolidated text Journal of Laws of 2026, item 34 as amended) and in accordance with the executive regulations issued under this Act, in particular with the Customer Service Standards specified in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819). The standards for the implementation of the contract are specified in the aforementioned legal acts. 4. The contractor whose offer is selected as the most advantageous will undertake to submit, on behalf of the Contracting Authority, to the Distribution System Operator competent for the Contracting Authority, a notification of the conclusion of a contract for the sale of electrical energy to individual facilities. 5. The Contracting Authority reserves the right to withdraw from the sale contract for facilities where, due to the implementation of RES installations, it will be necessary to conclude a comprehensive contract. 6. The Contracting Authority requires that, in accordance with Resolution No. XXV/373/20 of the Małopolskie Voivodeship Sejmik of 28 September 2020 on the Air Protection Programme for the Małopolskie Voivodeship, the electrical energy supplied to public utility buildings comes from renewable sources. The Contracting Authority agrees that the certificate of confirmation be issued to the Contracting Authority within 180 days after the year in which the sale of energy from RES takes place. The estimated total volume of energy from RES in the years 2027, 2028 is contained in annex 10.2 to SWZ – columns 7-8 of the table. 7. Place of performance: the territory of the Municipality of Wadowice.
